House Values, Just Listed deceptive marketing, Breach Of trust, Dishonest Dealing, Fraud, false lead and non productive leads

At the end of the month of January' I was approached by House Values Representative via phone solicitation to try their product (purchasing buyers and sellers leads) as a realtor, which I agreed online and after filling out the pertinent personal information to start the services and clicking the "Complete Order" button I then received access to their website and their online contract "Terms and conditions" which are emailed after the fact. We did not review this information together and the "Perks" of their program was the only issues we discussed at the time of signing up. Not the drawbacks. One of House Values policy is no cancellation for a year. Within two weeks time frame I discovered the leads were not Realtor Friendly but people who were looking for the value of their home for HELOC'S or Buyers who where surfing different websites to find a great deal on their own. (I have now learned "House Values" denoted people not looking for professional real estate service but rather independent research)

Within two weeks of signing up I called and explained what was happening that people were looking for the value of their home for HELOC'S or Buyers who where surfing different websites to find a great deal on their own. I sent all the complaints I had at the time and the original emailed request to cancel my service within the first two weeks hoping I would just be released from their service. I received a half hearted answer From Jon-Paul Deismone and other House Value Reps, because I called several times and sent emails, to other reps they stated they would have to get with their manager and see what they could do.

In the meantime I had a automated debit from this Company which caused my account to go into the negative and I went into my Wachovia Local branch office on March 7th and filled out a one page dispute form requesting this automated debit system be stopped because I cancelled the service.

The bank stopped the service and reversed the charges in a manner of what they called a provisional courtesy credit. I had to repeat this above mentioned process not once but twice and the last time the bank placed a "Freeze" from House values automatically debiting my account until further investigation could discover the facts. At this time the account manager from House Values George Runkey and a lady named Stephanie, contacted me and advised me I had signed up for a year they would like to work with me and would even discount the price to keep me as a valued customer but if I did not continue with the service they would send my account to a third party collection agency for recovery of the balance due of roughly $5,450.00. House values and I conversed up until the month of April' via email and phone with no resolution.

Approximately three months went by and I received a package from Wachovia Check card Research Department on June 7th outlying their decision to favor House Values decision to debit my account automatically and also House Values in their defense to Wachovia Check Card Research sent selective emails namely where I requested cancellation and their denial of clear absolution from my financial responsibility. They also sent the online agreement which outlined a no cancellation policy. Wachovia stated in a letter sent to me I would have to make provisions to have sufficient funds in the account as they were going to allow House Values to debit the account and I would have to take up the term of the rest of the contract with House Values. I called Wachovia research department and explained no one had called me and asked for supporting paperwork stating my position which had been circumvented and would have better shinned a truthful light on the situation and explain my position in detail. I was told to submit paperwork via fax (Which I did in access to 74 pages plus) and was told I would be contacted back from someone in their department but I have not thus far.

My points of view which seem to carry no consideration thus far are:

1) None of the leads provided by House Values were people who were looking for real estate service from a realtor. Consumers that were sent to me were looking to do research on their own not to procure a realtor. Although this

2) House Values cancellation clause does not make provisions for these type factors. The Contract is unilateral. Although this may be legal it certinally is not ethical or moral.

3) I followed House Values program and quickly became one of their certified House Values agents so it was not an issue of my performance. I believe their marketing is deceptive to the public and professionals in that I was lead to believe these consumers were looking for assistant from an agent. They are not and the public believes they can freely discover House Values without being hassled or hounded for their business. As seen on: www.housevalues.com
