Dr Diwan Rahul Nanda made his commitment to purchase a diamond from a prestigious private collection in Europe. He was introduced to this diamond in September / October by a business colleague by the name of Sanjay Syal who was Dr Nanda’s friend. After viewing the details, Dr Nanda confirmed in writing, his interest and commitment to purchase the diamond.

Diwan’s initial communications and confirmations of purchase within time scales were sent via Sanjay. Diwan also confirmed that he would attend a meeting in London with Sanjay and I on two occasions, so that I could show him private documents in relation to this diamond. However, Diwan always cancelled the meetings at the last minute and Sanjay conveyed various excuses for the cancellations.

Moreover, Diwan and Sanjay were introduced to the Principal Owner/Seller of the Diamond so that they could finalise the meeting for the viewing and purchase of this stone. However, in-spite of numerous confirmations of purchase verbally, by e-mail and text to the Principal Seller, Dr Diwan Rahul Nanda constantly kept postponing the meeting with the Seller. Diwan confirmed dates and even timings for meetings with the Principal Seller on numerous occasions, however at the last minute he came up with various reasons not to honour his commitment. Some of the excuses that Diwan came up with to postpone or cancel his meetings with the Principal Seller were related to work, death, travel and religious rituals. This definitely cannot be deemed to be the behaviour of a Professional as Diwan claims to be.

Until this time, I trusted Sanjay and believed that he was telling me the truth, especially as he pretended to accept that Diwan’s behaviour was not professional. At the onset, several times Diwan was given the opportunity to withdraw from the deal, if he could not afford / did not want to make the purchase of the diamond, but he continued to dupe the Seller by insisting that he wanted to complete the purchase.

Many months passed and he had still not fulfilled his commitment to purchase the diamond. However, Diwan kept making false promises and confirmations to the Principal Seller. Furthermore, I have wasted vluable time on phone calls, e-mails and meetings with Sanjay Syal to discuss this matter in order to resolve the situation.

Sanjay constantly reassured me that Diwan would perform and many times mentioned to me that Diwan was making arrangements to travel to inspect the diamond and complete the transaction and conveyed messages from Diwan.

The Principal Seller then asked us not to put any pressure on Diwan because he had mentioned that due to pressure he was not able to concentrate. Thus, for over one and a half months, only the Principal Seller communicated with him in order to complete the transaction without further delay. However, even during this time Diwan kept making various excuses and did not fulfil any of his promises to travel to meet the principal and purchase the diamond.

At certain times, when Diwan said that he was travelling, we conducted due diligence and discovered from Diwan’s office personnel in London that he was actually in England (sometimes at meetings) and not travelling abroad as he claimed to the Seller. This goes to show the calibre of this person.instead of withdrawing from the transaction with grace and paying compensation to the persons concerned, he continued with his disrespectful and unethical behaviour and incurred expenses to the Principal Seller who had to cancel other appointments to be available for meetings on several dates confirmed by Diwan.

Furthermore, London based Shield Guarding Company is part of Topsgrup, which has its headquarters in India and is headed by Dr Diwan Rahul Nanda. However, Diwan is also a liar, time waster and a non-performer who should not be trusted. Diwan has no business ethics or respect for other people.

Mr Sanjay Sayal of Finchley London introduced Diwan Rahul Nanda. Within a very short period, the Principal Seller’s information was provided to both Sanjay and Diwan. We asked Sanjay for Diwan’s full contact details but he failed to provide this information and came up with various excuses of his own why he would not provide this information. We then contacted Diwan’s secretary, Ms Gemma Barrett and sent her an e-mail to be sent to Diwan, she honoured the request and sent me confirmation that request had been actioned.

Sanjay confirmed that Diwan wanted to pay compensation and close the chapter. Diwan then contacted me via a Hotmail account and mentioned compensation and an agreement. However, we knew that this was yet again a delaying tactic. Furthermore, Diwan wanted to agree on a settlement without having to go to court and had the audacity to ask me to draft an agreement on his behalf. I refused and said that he should draft his own agreement and send for our perusal and make the payment within a set time frame. However, Diwan failed to do this and honour his e-mail confirmation to pay compensation.

Furthermore, we also discovered that a phone number that had been sent to the Principal Seller as Dr Nanda’s new phone number was actually one of Sanjay Syal’s phone numbers. It was only later that Principal Seller realised that when the Seller called this particular number, the communication was actually with Sanjay and not with Diwan (even though Sanjay pretended to be Diwan during the communication). We only discovered this because Sanjay’s regular phone went in for repairs and he started using a new phone with a new number which we realised was the same number given to the Seller as Diwan’s new number. Thus, what we have concluded, taking into consideration, Sanjay’s behaviour during the entire episode and the contradictory information that he provided, either Sanjay and Diwan were in cahoots and lying from the beginning or Sanjay was helping Diwan to dupe all people concerned so that he could withdraw without paying compensation.

As business colleagues, the professional method is to provide full disclosure by an exchange of a Client Information Sheet (CIS – which provides personal information of an individual) before commencing on any kind of venture. Even though, my colleagues and I made many requests from Sanjay for his CIS, he somehow avoided providing any personal information, including his landline number. The only information he provided were a mobile number and an e-mail address, even though we lived in the same country and we have met each other many times.

I have now made a decision to take legal action against Dr Diwan Rahul Nanda and Sanjay Syal for providing false information, misrepresentation, non-performance, false promises, loss of income so that they would never behave in this unprofessional and unethical manner in the future.
