If you're running a small business like I am, please inform your employees not to accept any solicitation over the phones because your company might end up paying for a useless service with your hard earned income.
This is how it began. My leasing manager received a phone call from ADS (American Directory Services) on 10/29/04 for adding our company's information on their yellow page directory listing. She misunderstood ADS with the Yellow Pages Hence she agreed a deal of $379.95 for two years of listing plus a copy of the directory. I did not know this matter until I received ADS's invoice this week.
As soon as I talked with my manager and understood that she mistakenly ordered the wrong directory, I called ADS's customer's service to cancel our listing on the directory. The head of the CS department told me that it was too late to cancel because they already printed the directory. After another fifteen minutes of conversation with him, he insisted that we owe them $379.95 or a reduced rate for $249.00 on one year's listing. Later he informed me that whenever the customer accepted their service over the phone, the deal between two parties becomes legally bound. "Shouldn't you told me in the first place that it was the verbal agreement on the phone that prevents me from canceling the service instead of saying you already printed the directory?", I asked him.
Then he corrected himself but insisted that I have to pay. Therefore, I told him to change the service to one year listing for $249.00. Then he told me $249.00 only includes listing fee and I will not be getting a copy of their directory.
Here I am, paying for $249.00 of service that I don't even get to see the product. Please don't let this same thing happen to you and your employees.
