Misleading Crooks - Bally Total Fitness is out to steal your money

I've read quite a few reports online now and I'm not surprised so many have had the same experience as me.

Over a year ago I walked into a Bally's looking for more information. Hungry for money Tony told me if I signed up that day for a membership he would get me a great discount, and if I decided I wouldn't use the membership I could cancel within 60 days. He took $10 from me to get started, and sent me on my way.

After a month, I wasn't going very often and I started having some health problems that were causing me a lot of pain. I called customer service and told them I would like to cancel because of health problems. They told me I would need a doctors note. I told them it was within the 60 day time period. They told me it was their policy and I would need a note.

Then the phone calls started. Every morning at 7am, I received the first call, another 5 calls would come throughout the day saying I owed money. I was on the verge of reporting them for harassment. I called back and they told me I couldn't cancel because it was after 60 days. I told them I had spoken with someone and was working on getting a doctor's note. They said it was too late.

6 Phone calls later, they started telling me I couldn't cancel because I hadn't used the gym 17 times. I was never told that by Tony!

The calls continued and I told them every time I wasn't using it and wanted to cancel. I ended up moving where there was no Bally's and they finally let me cancel. Only then they started sending me bills for $400.

For a membership I didn't want or use!

I found my contract and I hadn't even signed it. How can they hold me to something I never signed?

I called again and again, and told them I was pressured into agreeing to something I didn't understand and wasn't even sure I had ever signed anything. They told me I should know to read everything before signing.
Shouldn't Tony have mentioned the "small print" when he was telling me to sign up now? Or was he in too much of a hurry to make his commission?
I told them I wanted to file a complaint against Tony and that my next step was to call the Better Business Bureau. Suddenly, I owed them nothing.

Situation resolved?

I'm still waiting for a letter, and wondering if they'll have my credit fixed.
I also find it really shady that the moment I mention the BBB, they drop everything. What are they hiding?

Needless to say, they lie, cheat, and steal. Class action anyone?
