Dave's Furniture World Consumer Complaint

I want to share with anyone interested, my consumer complaint against Dave’s Furniture World in Bloomington, MN.

In February I placed a bunk-bed and twin mattress on layaway at Dave’s Furniture World. From that date to April I paid a total of $146.

At no time did Dave’s Furniture World inform me that if the layaway purchase was not completed my deposit would not be refunded. The layaway receipt does not state anywhere that if the layaway purchase was not completed my entire deposit would held.

Due to a change in my personal financial situation, I notified the owner of Dave’s Furniture World that I would not be able to complete the purchase and asked that my deposit either be used to make a different purchase or for a refund. I was more than willing to pay a reasonable service fee for his inconvenience. The owner of Dave’s Furniture World responded that if I opted not to complete the original purchase he would not refund any portion of my deposit and making a different purchase was not an option. The owner of Dave’s Furniture World told me that if I wanted my deposit refunded, I should contact an attorney to get it.

At that point, I filed a complaint with the Minnesota Attorney General’s Office and The BBB of MN/North Dakota. The owner of Dave’s Furniture World contacted me after receiving a letter from the Minnesota Attorney General’s Office and offered me a settlement of $100 w/the stipulation that I notify the Minnesota Attorney General’s Office that we reached an agreement. I considered his offer fair and acceptable so I did write a letter to the Minnesota Attorney General’s Office.in the letter I did clarify that my acceptance of the settlement offer is null and void if the owner of Dave’s Furniture World did not honor his end of the settlement offer within one week of the date of my letter and I would then re-file a complaint with the Minnesota Attorney General’s Office and explore my legal options to retrieve my deposit.

The letter, copies of our email correspondence and a stamped return envelope were mailed to the owner of Dave’s Furniture World and he responded to me via email “No deal. SUE ME!!! Thanks and Good Luck!!! ”

In these hard economic times it’s sad that a business would take advantage of it’s consumers. There would be the cost of filing a claim in small claims court, taking time off of work to pursue the claim, and if I win there’s no way to really “make” Dave’s Furniture World return my refund.instead, I re-filed a complaint with the Minnesota Attorney General’s Office and decided to share my story with anyone interested.

Dave’s Furniture World is not out any amount of money or merchandise yet still refuses to return any portion of my deposit. I, on the other hand, am out $146 and have absolutely nothing to show for it.

Dave’s Furniture World & Fineart is currently location @ 2230 W 94th St, Bloomington, MN 55431 but will be moving to 6315 Penn Avenue South, Richfield, MN 55423 on Sept. 3rd.
