Ms. Jeannie Wilson owns property (actually she is the president and everything else except vice president in the Florence Management Corpotation) in the city of Park Hills. The property is run down and the back yard (which is next to my driveway) is overgrown with trees (many dead), poison ivy, weeds, bugs, trash, rats and other stuff I don't want to know about.
She has been sent complaints to her home address (P.O. Box 169 Dry Ridge, Kentucky 41035) because they have come back wrong address numerous times by city administration and claims that she's never received any of it although admittedly that is where she gets her home mail.
After cleaning up the garbage that falls into my yard since the spring of 2001 one of her large dead tree branches fell on my car in which I had just sent the 6th payment in on. (Bought it brand new) The branch left a 1 1/2 inch long scratch and 1/4 inch wide (all the way down to the metal). I finally called the county and after some detective work was able to get Ms. Wilson's home phone number (because the one she gives for the business above has never heard of her) and home address.
I called for two days and left messages on her machine letting her know of the problem. On the third day she informed me that she was in my area and would stop by to look at the damage.
Ms. Wilson DID stop by. She didn't knock on my door, she just proceeded to wander into my yard and start cutting down branches. I went out, introduced myself and told her I had already taken pictures of the overgrowth. After a war of insults she told me I could use her body man who was 2 hours from me or nothing at all. I asked to see if there was any work done on her big shiny new truck. She said yes.
He had put two hood vents on the hood. He painted them and placed them. I informed her that one of them was coming up and she refused to look and replied "no it can't be because he put it down with double sided tape" (I didn't know that double sided tape was so good! Why do we bother with stitches anymore? Why don't we use this wonder product on organ transplants?) I told her the mechanic wouldn't be allowed to paint my tricycle let alone my car. She commented that my car was a cheap piece of crap anyway and the tricycle was probably worth more.
As she backed down my narrow street I wanted to get her license plate number just in case. I Kentucky we are only required to have a back plate so I was walking on the passenger side. I noticed that she didn't back very well (she drove in my YARD) because she was only four inches from the retaining wall and that maybe she should get some lessons.
As I stood at the front corner of the hood on the passenger side (about four feet away) she slammed the transmission from reverse into drive so quickly I thought she had dropped her transmission. She proceeded to floor the accelerator and turn towards me.
I jumped out of the way quickly but she still made contact with the right sleeve of my t-shirt causing me to react by pulling my right arm back violently. I had my right arm completely wrapped around my back and was pinned against a field stone wall with my foot in the gutter. I pulled my upper right pecs, my shoulder ligaments, a back muscle and hyperextended my elbow. I begin phisical therapy in mid June.
To steady myself out of the gutter I placed my hand-palm down-on her hood (which was about 5 feet high) and she claimed that I hit her truck. I went into my home and called the police.
While the officer was en route to my house Ms. Wilson flagged him down saying that I had just "punched her truck". He made note but saw no damage. He then proceeded to come up and take my information. He said because he hadn't witnessed any of this he couldn't make an arrest that I would have to file a suit at the courthouse and then left.
I have the officer's report. It mentions NOTHING of the injury but does say that I hit her truck. It mentions nothing of the limbs down in my yard obviously but does say there's a minor scratch on my car (minor if the car had been totalled maybe).
It mentions the fact that he had to come back the next day because she again walked onto my property without permission with two scary looky men. Yelled at me when I came out on the porch "move your car bitch" but didn't tell me why. Also she had these "gentlemen" (who looked like they had just wiped out a club of Hell's Angels) walk back and forth in front of my house for intimidation.
I finally DID move my car when I found out why I was told to. The Ms. Wilson told the officer (it;s in his report) that she had nicely asked me to move the car so she wouldn't drop anything on it while she had the trees cut. Also that I had refused. He sent me to my home half a block down the street and would NOT speak to me as he backed out past my house and told me I would be arrested if he had to tell me to get back in my house.
I know I cannot sue a corporation but SHE IS the corporation. How do I go about this? She is a listed corporation with the Sectretary of State (KY) but in bad status. She's a slum lord and has evaded the city for three years.
I have filed criminal charges on her already but she isn't due in court until July.
Any help would be appreciated!
