1.in response to e mail inquiries sent out by my wife and i to various labrador breeder web sites, on or about august 11, i received a telephone call from an individual named jordan, who stated that he was a breeder, specializing in english blocky style labradors on his 300 acre farm property in north carolina and associated with an agency known as anypet.com (he told both my wife and i that all of the labradors listed on the anypet.com web site were his and that he raised them on his farm in north carolina).

2. During our telephone conversation, jordan went on to state that he received our inquiry for a large english style blocky labrador and had a specific labrador that he beleived was consistent with what we were looking for.

He told me information about the puppy and its parents:

A. The father was a 96 pounds pure bred yellow labrador with an english blocky head

B. The mother was a 87 pound pure bred black labrador with an english blocky head

C. Both parents have had their hips certified and he explained the procedure that he went through to certify their hips (at age 2, having their hips imaged to ensure that neither had any hip issues nor eye problems).

D. Both parents were akc registered

E. The puppy would be akc registered

F. The puppy was the largest of the litter and first in the birth order

G. The puppy would come with a 10 year warranty becasue of the certification of the parents hips and eyes.

3. Since neither my wife nor i knew jordan nor his operation, i asked him if he would send us pictures of the parents and the puppy.in response, jordan immediately e mailed us pictures of the parents and the puppy.

Jordan then spoke with my wife and relayed all of the same information as to his backround with breeding, his farm property where he raises the labradors and confirmation as to the parents and the certifciation process.
The kicker to his story was his claim to both of us that the puppy was already crate trained and about a week or so away from being fully house broken.

4. Based on jordans representations and the follow ups to our questions (and his prompt submission of pictures of the parents and the puppy), my wife and i decided to pay a premium for the purchase of this puppy. (997.00).
Knowing that the puppy was certified as to his hips and his eyes and knowing that we were getting a particular type of labrador, we decided to pay the extra money.

5. During the conversation, jordan also explained to us the process of shipping the dog to us. He told me that he only ships his puppies on continental airlines because it ships the puppys in the cabins instead of in the cargo area, creating less trauma for the dog. He also uses direct flights so as to reduce the amount of travel time involved.

6. Lastly, jordan assured both of us that when the puppy would arrive, inside the crate would be all of the dogs akc registration papers, the parents certification papers, and the vet papers, confirming the history of care.

7. Based on his representations and the pictures of the puppy and the parents (and his representations as to what materials would be sent along with the puppy), we agreed to the purchase and to pick the puppy up at newark airport on sat august 25.

8. Based on the all of the abovementioned information, we paid (via credit card) the total sum of 1286.00; which reflected the purchase price of 997.00; crate cost of 65.00; health certifcate cost of 35.00 and shipping cost of 189.00

Not one of jordans representations were truthful.

10. On or about august 17, i received an e mail from a woman identified as aislinn abella of anypet.com ; who indicated that she was the flight coordinator for the puppys travel.in her e mail, she indicated that the puppy was traveling on americans flight 560 and would be arriving at 12:40 pm on sat august 18.

11. That information made no sense to me whatsoever since the dog was supposedly raised in north carolina. It also made no sense why the puppy was being shipped on american airlines when jordan told us that the puppy would only be shipped on continental airlines (for the reasons set forth above).

12. I immediately wrote back to aislinn, asking her for an explanation. Unfortunately, we never got an answer to our questions from her. She provided a noonanswer as to why the puppy was being shipped via american airlines and no answer as to the breeder.

13. As a result, we wrote back to her again during the evening of august 17 expressing concerns as to her nonresponse to our questions and expressing concerns for the deal (since she would not answer our questions).

14. Later that night, we found that the flight (560) had been cancelled and therefore we immediately notified her of our intent to cancel the deal completely.in repsonse, during the evening of august 17, aislinn wrote back that she would let the breeder know not to ship the puppy and that we needed to talk with marlene of her office on monday to cancel the whole deal.

15. The next time i heard from aislinn, was at aproximately 1 pm on august 18, when she called my cell phone (she had our home phone and both of our cell phone numbers), telling me that she was unable to stop the breeder from shipping the puppy and that we had to go to the airport to pick him up (since he was registered in my name).in response, i told her that we had cancelled the contract and that we had no plans to pick the puppy up. I told her that she had no right to go ahead and ship the puppy and expect us to pick him up especailly since she had time to stop the delivery either before the flgith left or when it landed in dallas. No reply.

16. I then received a frantic telephone call from a woman from the same agency named marlene who identified ehrself as the manager in charge of flight coordination; who begged us to pick the dog up since he was already in transit. I reiterated that we had cancelled the contract and that it was unfair of their operation to thereafter ship the puppy, knowing that we told them not to do so. Again, no response.

17. The next phone call we recieved was from a woman associated with the same agency telling us that the dog was delivered to newark airport under our name and that if we did not pick him up, the airlines would call the humane society and file a complaint against us. Based on that threat, my wife picked the puppy up from the airport.

18. When my wife got to the airport, she noticed that none of the information that was to accompany the puppy (akc registration, medical vet information, parents certifications, etc) were with the puppy nor in his crate. My wife then immeiately called the number given for the agency and was told that someone associated with teh airlines must have taken the information out of the crate. My wife then spoke with the representatives of the airlines, who confirmed that no one had entered the crate (since it was still sealed) and that no one removed any travel papers.

19. Once we got the puppy home, we noticed that the flight information affixed to the outside of the crate referenced the name of the actual person shipping the puppy (kristen potleiger). As a result, my wife and i tracked her down and were able to speak with her later that night. The information provide to us from her confirmed the extent of the lies told to us by jordan and his agency.

20. Kristen (the actual breeder) then told us the following:

A. She was a biology teacher in missouri, who decided to breed her personal labrador with a friends personal labrador and that she was not a labrador breeder at all. (though she did breed terriers).

B. Jordan was simply a saleman, who works for the agency that she sold her puppys thorugh and had nothing to do with the puppys breeding

C. The puppy was not from north carloina and had never left her property in missiouri

D. The parents of this puppy never had their hips or eyes certified and that no testing was ever done to the parents to determine whether they would have hip issues in the future

E. The pictures sent to us by jordan of the parents were fake. She then sent us pictures of the real parents, confirming that they are not english blocky style labradors nor the size represented.

F. The puppy was not crate trained and had never even been inside her home

G. The father was about 75 pounds and the mother was about 65 pounds

H. Both parents were black labradors (as opposed to the father being a yellow labrador as represented by jordan)

I. She has no idea as to where this puppy was in the birth order since all of her litter was black. The puppy was simply not the biggest nor the smallest since those 2 had been already been sold.

J. No one from the agency called her on her home phone (which number she indicated they had) to tell her not to deliver the puppy to the airport. The only message that she received was a mesage left on her cell phone, wherein she was told that there was some issue with regard to which airlines the puppy was to be shipped on. She indicated that when she called aislinn back, aislinn told her not to worry about it and that she (aislinn) would address the issue when she got into the office in the morning.

Essentially, everything that we had been told by jordan about this puppy was a lie.

So as to avoid any question as to the misrepresentations made to us by aislinn, marlene and jordan, we have all of the e mails between them and us as well as all of the pictures.
We also have kristen potleiger number and address; who will also confirm their fraudulent actions.
