Failed to deliver hot tub paid for in October Kansas City Missouri

I purchased a hot tub from Mybath in October as a listing on ebay. The shipping terms stated it would ship in 6-9 weeks from purchase. I mailed Mybath a check in October ($3700) it cleared immediately. I waited about 9 weeks and contacted (by phone and email) Mybath (Jeremiah and John) concerning delivery of the the hot tub. Mybath staff reported that the hot tub was stuck in customs in Long Beach, CA and as soon as it cleared customs, they would ship the hot tub, delivery should occur before year end.

The story about stuck in customs lasted about 2 months.

Then the story changed to the hot tub is ready to ship out, then the story changed again, the hot tub was broken when they were getting it ready for shippping. Mybath refused to refund the money, but did suggest I could exchange the hot tub for store credit and would send a store inventory to select from, the inventory listing never arrived.

I then received a letter from My Bath, Inc. That they had went of of business and if we had an outstanding order it would not be able to be filled/delivered or refunded to the business failure. They then apologized for any inconvenience. It was also stated that IF bankruptcy was filed we would be listed in the bankruptcy as a debtor and a seperated notice would be sent.
