In May Mark Hemenway gave me an estimate of $1,000 to replace and extend a septic tank line in Bourbon County. I signed a contract with a warranty agreement. Mark said he would bring it to me. On the day of the work, I received a call from my brother who watched the process througout the day that Mark did not dig the ditch out deep enough. I spoke to Mark who assured me that it was deep enough.
Later that same day, Mark came to Lexington for me to pay him for the work. I did and asked for a copy of the contract I had signed and a receipt for full payment. He was to mail both items back to me. The invoiced arrived by e-mail, but the contract never was received.
A few weeks later, I received a complaint from a neighbor that the septic water and waste was on top of the ground. I called Mark. He refused to go back and correct the problem. He has been very nasty and arrogant. I called Mark several times again. I sent e-mails to him. I continued to receive complaints from the neighbor. Also the neighbor complains each time to me and my brother when we are at church.
In November I made a visit to Mark's company to get a copy of the contract (I took a witness with me). Mark said it would take time for him to find the contract, he put some time of note on the invoice I had that noted I had paid in full.in November 17, I sent him a certified letter. He would not take it.in January I sent another certified letter to his home. It has not been received to date.
In January I sent another certified letter to his home. My next step will be Small Claim Court. This man is no better than a highway robber. If you have had a similar experience with this company, please make a report.
