Deck And Gazebo DKick Would not repair poorly constructed bulkhead that collapsed due to poor design

Chris Kick, aka Knute Chris Kick, aka Houston Marine Construction, aka D & G Design, aka Deck and Gazebo Design, aka Shoreline Construction Services built a new bulkhead for me in late summer of 2004. He had given me a set of bulkhead designs which called for tie-backs every five feet. About two thirds of the way through the job he changed the design.in the area of my existing boat house he decided to only use tie-backs every ten feet, using a smaller tie-back rod into an existing piling supporting the roof of my boat house. As a professional bulkhead builder, he assured me that it would be just as good as the original design.

Less than two years later during a rain storm the bulkhead under my boat house collapsed, hitting the side of my boat and then resting below the boat. I was unable to lower my boat into the water.

I called Chris Kick within minutes of discovering the problem. He told me that he would be too busy to come look at the problem for several weeks. He told me that I had approved his changes, (which he had told me would be just as good as the original design). He suggested that I call another construction company to do the repairs and that we could determine responsibility later. He asked if I could e-mail him pictures of the collapse, which I did two days later.

The next day I called another bulkhead construction company and asked them to come and look at my problem. They were there within hours. They evaluated the problem and said that there should never be more than five to six feet between tie-backs, not ten feet. They also said that the back fill should have been dirt, not sand. Dirt is more stable. They agreed to give me a quote for the repairs, but suggested that I try to get Chris Kick to do the repair.

The day after I e-mailed the pictures to Chris Kick he called me asking me to re-send them as attachments so he could see them better. I re-sent them as requested the same day. I asked him again to come and look at the problem. He said that he was still too busy. This was the only time that he called me. After this he never answered any of my calls or messages.

About two weeks after the collapse, I sent Chris Kick a letter Certified Mail with Return Receipt. Two notices were placed in his U.S. Mail Box a week apart. The notices and his mail were picked up regularly, but he did not pick up the Certified Mail I sent. The Post Office returned the letter to me after fifteen days of not being picked up.

Six weeks after the collapse, Chris Kick showed up at my house un-announced to look at the problem. He said that he was on the way to another job so he stopped by. I asked him about the Certified Letter that I had sent to him and he said that he didnt pick it up because he knew what it was about. He looked at the damage and his suggestion was to increase the size of the waler board and to still only use three tie-backs ten feet apart. I asked him to give me something within a week in writing with details that I could have reviewed by the other contractor. I never heard from him again. He did not bring any equipment to pull the bulkhead from under my boat so I still could not get my boat into the water.

About two weeks later I sent Chris Kick another letter, with a copy of my first letter, asking him for details of how he would repair the bulkhead. I still never heard from him again.

About two weeks later I hired the other Construction Company to do the repairs. They completed the job on schedule and within budget. If anyone needs the name of a good bulkhead builder, I can give it to you. NOT Chris Kick.
