Xtreme Metal Buildings Failed to provide proper plans, then refused to return messages, didn't deliver and failing to provide refund

My wife, Crystal and I ordered a 40"x50" steel building from Xtreme in March. We agreed to pay $14,900 and gave a $5,000 deposit.

We paid an additional $1,500 (included in the total price) for engineered plans, required by the State of Arizona for building permits. The building is the basis for our modern home.

Xtreme's salesperson, Adam Nordwall, told us that we could take delivery of building in Summer 2007. The date is critical as this building is being delivered to a remote site in the mountains of Arizona and roads are impassible by truck between Oct-April.

We were told to expect engineered plans in two to three weeks from the time of deposit. The order went fine, the specs were correct and we signed off. We gave Xtreme $5,000 — which is more than the deposit requested by Xtreme. During this time frame, we asked that Adam Nordwall put my wife on the contract — in doing so he changed the purchaser information to read only as my wife's name and the delivery address to my name.

March was basically the last time we heard from Xtreme. That is, unless we called or emailed and even then, we never heard from them other than to be placed on hold.

Some of the issues we've dealt with:

1. Lack of customer service follow up. We've called in excess of 67 times since March and never once recieved a call back.

2. Four sets of error ridden drawings/plans, including one set that was engineered.

3. Near delivery of the wrong building in June prior to our receiving a set of plans (that we paid for)

4. Failure to send plans in a timely fashion (we finally recieved an engineered set in June a week prior to the scheduled delivery and they were wrong as was the building)

5. Belligerent treatment from a man that answered the phone when my wife called to inquire about our building in June, prior to our finding out the (incorrect) building was going to ship.

6. Failure to deliver the building in the summer of as promised

7. Being placed on hold when we call and being left on hold for 30 minutes on 17 occasions.

Due to Xtreme's in ability to deliver even a set of plans on time, we will now have to pay higher building fees. The plans were supposed to be submitted to the building department prior to a major (double) fee increase in our County (Yavapai County, Arizona) in September.

After repeated calls to Xtreme, I finally got in touch with Miriam Waymire in mid- July — after a 45 minute wait on the phone. Miriam is Steve Rankin's assistant. She told me that she would send a revised set of drawings "soon". I received those drawings at the end of August and they were incorrect. I immediately informed her of such via email. I did not hear from her for another two weeks, when she asked me to approve those incorrect drawings. After an email telling her they were incorrect, she again sent another set of incorrect plans. This occurred two more times.By then, our building project was put off an entire year due to Xtreme's mishandling of this sale.

Steve Rankin, the company president stepped in during this time frame. I continued to deal with Rankin until October 1. Shortly prior to this time frame, I became frustrated with Rankin and demanded action from his company. At this time, Rankin told me that I was not on the contract and that he would not take my email or calls unless I was a more passive customer. I was very curt with Rankin, and told him what I expected of his company. He would not accept my requests and threatened to "cut me off".

My wife, at this point, was so upset with her poor treatment by this dishonest company, that she refused to deal with anyone there. She wrote Rankin a note telling him that his company screwed up in taking me off the contract, demanded that he put me back on the contract and demanded that he deliver on the building as we had agreed, within specified requirements.

After recieving this note, Rankin sent me an email telling me that he could not do business with us and that he would be issuing a refund check on October 3. The date of his correspondence was October 2.

On October 17, I wrote Rankin asking where the refund was, he told me that it would be issued at the end of the month.

At the beginning of November, I again wrote and called Rankin to ask where the refund was — he is no refusing to answer my emails and calls.
