Ripoff blatant disregard and extreme lack of quality

After moving into our brand new condo 10 months ago, my wife and I were recently greeted by a surprise we hadn't bargained for. She has been using tampons, like most women for years without incident and now... After 10 months in my new condo I find myself wading through a pool of sewage all over my office and welcomed by a revolting stench throughout my home. Everything in the condo was brand new including the carpeting and wood floor and it is now destroyed.

I brought this to the attention of the builder and a representative of the condominium association and without review they have denied my pleas to replace my carpet. I have paid monthly dues like all condo owners in order to protect against defects in the home and expected there would be a warranty or rights to protect me as the innocent consumer. To my surprise, while they did send out a plumber to assess the situation I was told that it was my wife's fault for putting "foreign objects down my toilet despite persistently advising them that all tampons are flushable PER THE MANUFACTURERS DIRECTIONS ON THE BOX. Their only response was you wouldn't flush a rag down the toilet just because someone didn't tell you not to".

Being a migraine sufferer and severe asthmatic she now finds herself struggling for air and the relief of a day without a headache. All because the association/builder will not replace the carpet that was destroyed by the sewer system they designed with a plumbing contractor named RCI Mechanical. I have reviewed my home owner's manual and there was never any indication at any point, verbally or written, that disposing of flushable feminine products in this way was forbidden or discouraged. It is common knowledge not to flush tampons in homes utilizing a SEPTIC SYSTEM; however, being the resident of a fairly large city I believed my wife would be able to sanitarily dispose of a product that is flushable.

In an effort to resolve the situation we have independently contacted numerous plumbers in the hopes that someone would advise the builder that tampons are in fact flushable, biodegradable, and should not clog up a brand new homes plumbing system. Despite our efforts the doors were shut on us and all advised that tampons should never be flushed. How is it that the manufacturer of a product can advise that their product is flushable and I can end up with my brand new carpet ruined? No one will take responsibility for this situation, and by merely following the manufacturer's directions on the box, I've created a situation that is difficult to escape from.

So whose problem is it, the manufacturer for falsely advertising a product as being safely flushable in homes, or the builder for manufacturing a brand new home with a sewer system that cannot accommodate a product that most women use on a frequent basis? Everything we have tried in order to resolve this situation is going unmatched and unnoticed
