Ripoff Non-existent Warranty and Service

We purchased a home from LUV Homes and moved in on April. We had the usual walk through the night before we moved in. The manager assured us that everything would be fixed and we would be 100% satisfied when it was done. This was on a Thursday night. We were keeping our appliances from our old house and they said they would move them in for us.

On Friday afternoon when my husband arrived at the new house there was only a refrigerator. We thought maybe they left the range in the garage. After looking around my husband called me. I then called our saleswoman at LUV and she said she would call me back after she checked with the service guys.

About a half hour later she called back and said she had some good news and some bad news. The two guys who were moving the appliances had a small accident with the stove. It bounced off the trailer. But the good news was there would be a new one to replace delivered on Saturday morning. We arrived with our moving truck on Saturday at 11 am and no stove. I called her and she said "Well, they are on their way".

From this point on everything was down hill. The next week they were suppose to come and fix everything. No one ever showed up from LUV Homes. One person showed up to fix the west end of the house that was sagging. No one had ever mentioned to us that there was a problem. LUV had called them even before we bought the house because they knew there was a problem.

Then, about a week later, the weather got cold. We noticed there was no heat coming from the registers on one half of the house. I called again and she told me that no one would be able to come out until Monday because the guys were at another house that had a plumbing problem. She then told me if we wanted to stay warm we should just stay on the side of the house that had heat!

For several more months we tried to get them to come out and fix all the stuff that was wrong. We asked her if we needed to get a lawyer. She said if we threatened her again, she wouldn't send anyone out until they heard from our lawyer. We faxed the repairs into them, like the contract said, but still no response. This went on for several more homes.

Finally, I sent an email to their parent company, Clayton Homes. A manager finally called us from Tennessee. He was very rude and said that they had tried to work with us, but we didn't cooperate. They said someone would be out the next week to fix stuff. They were suppose to be there first thing in the morning. They showed up at 10 am. To me, that sure isn't first thing. Clayton Homes sent the email to LUV and I received a call from the manager. He said he had no idea that nothing had been done yet.

When they did show up, they should have brought some competent workers instead of the ones that showed up. When they got done "fixing something" it was worse than when they started. So, every time they tried to fix something we took pictures. Good thing we did. We have yet to get all the things done.

In Jan, we noticed the floor beginning to sag on the other side of the house and half across the length of the house. At this time I called to talk the manager. The original manager we dealt with was no longer employed there. The new manager was a real jerk. He told me that they weren't not going to fix anything else on our house because the warranty was about to expire. We still had 3 months left. He told me to turn it in on our home owners insurance.

We have a severe rodent problem because the skin underneath has big holes in, the siding is crap, there is glue all over the walls that have vinyl covering on them, the curtains were all stained, all the windows leak because they were never sealed, the shingles are bad because of the way they tried to fix them, the floor joists are broke under half of the house, and all the walls have cracked. We had to install hardware cloth in all of the heat registers just to keep the mice from coming in.

We contacted a lawyer and he just couldn't believe what we have been through. We couldn't afford to hire him, besides our contract states that we would have to go through arbitration. He gave us a lot of information on the laws in Colorado that cover manufactured houses. We hav also contacted the Attorney General, the Better Business Bureau of which they are not a member, and the original manufacturer of this house.

We finally did hear back from the manufacturer, but they are located in Wisconsin and don't know when they will be able to investigate.in the meantime, we are paying interest on a huge mortgage. I am sure the mortgage is a lot more than what this piece of crap is worth.

I am writing to ensure that other consumers don't get ripped off like we did. The best thing that the state of Colorado could do would be to revoke their license. At least then, other people wouldn't get screwed over like we did.

If ever there is a class-action suit filed against them, I would like to be the first on the list. I think they need to be taught a big lesson.
