If you signed a Moxie contract and want out, or got an unexpected bill
Check your online portal first. Moxie's own Additional Terms and Conditions say cancellation happens by visiting our website and logging into your online portal at moxie.pestportals.com/landing/index -- a phone call or email to a branch is not what the contract recognizes as notice. The same page says a cancellation submitted before a renewal term starts takes effect at the end of the current term, but one submitted after a renewal has already begun takes effect only at the end of the following term -- so timing against your renewal date matters. Screenshot the portal page showing your cancellation date and keep any confirmation.
If you are still inside the initial 12 months, the contract sets an early-termination fee equal to 80% of the service charges that would otherwise have been due for the rest of that first year, whether you or Moxie ends it (except a termination by Moxie 'for convenience'). Several of USAComplaints' own posts and BBB complaints describe disputes over fees charged on this basis.
Ask for the pesticide label. The contract states Moxie will provide the manufacturer's label for any pesticide used, on request -- useful if you want to verify a treatment or a pet or family member reacted to it. The contract lists the national Poison Control number, 1-800-222-1222.
If you believe you were billed for a visit that was not performed, or after a properly-timed cancellation, put your complaint in writing and, for a charge you never authorized, dispute it with your card issuer -- but a chargeback by itself does not cancel the contract. The contract directs unresolved complaints about service quality to a registered letter sent to Moxie's main office, 8404 Esters Blvd. Suite 100, Irving, TX 75063, and gives you the right to terminate if Moxie fails to resolve a material complaint in a reasonable time while your account is current. You can also file with the Better Business Bureau, and, for a pesticide-application dispute specifically, with your state's pesticide regulator -- for Texas customers, the Texas Department of Agriculture's Structural Pest Control Service, listed at (800) 835-5832 on Moxie's own BBB profile.
If a salesperson signed you up at your door within the last three business days, check the federal Cooling-Off Rule (16 CFR Part 429): for sales of $25 or more made at your home, the seller must give you a written notice of your right to cancel before midnight of the third business day after the transaction (text of the rule); state law may add its own cancellation window. Door-to-door permits are issued town by town; if you doubt a salesperson, check your municipality's solicitor-permit list or police department (two Pennsylvania townships revoked Moxie's permits in 2026, see the regulatory section below).
Read the arbitration clause before assuming you can sue in court: the contract routes disputes to individual arbitration before the American Arbitration Association in Dallas County, Texas, and separately has customers waive participation in a class action.
Company background
Moxie Pest Control provides door-to-door and subscription pest, termite, mosquito, lawn-care, attic-insulation and vole-control service under the trading name Moxie Pest Control, L.P. The company's own site says it has operated since 2001 ('for 25 years' as of 2026); a February 2026 PR Newswire release instead says the company was founded in 2000 -- the two dates are not reconciled here.
Founder and CEO Jason Walton built the business from what a 2024 Yahoo News profile described as a small start into what the company's 2026 press materials describe as more than 40 branches serving 40-plus U.S. communities, many organized as separate LLCs -- examples named in court filings and BBB records include Moxie Pest Control - Denver, LLC; Moxie Pest Control (Atlanta), LLC; Moxie Pest Control Florida, LLC; Moxie Services (Austin) LLC; and Moxie Pest Control (Utah), LLC. The company says it also operates two sister brands, Joshua's Pest Control and Mission Pest Control, covered by the same website Terms of Use.
A 2020 federal corporate-disclosure filing for an affiliated branch, Moxie Pest Services - Dallas, LLC, names Walton Holdings GP, LLC and Headrick Holdings, LLC as parent/affiliate entities -- consistent with the BBB's Irving, Texas profile, which lists Timothy Headrick as 'Partner' alongside Kristen P. Walton among the company's listed officers. Moxie's pest-control service contract names Moxie Pest Control, L.P. as the counterparty, with a main office at 8404 Esters Blvd. Suite 100, Irving, TX 75063; a separate entity, Moxie Services LLC of 4385 S 500 W Unit A, Murray, UT 84123, is named in the site's Terms of Use as operator of the website and customer app, under Utah governing law. In February 2026 the company announced a $200,000 grant ($100,000 a year for two years) to the American Foundation for Suicide Prevention.
What Moxie's own service contract says

- Term: 'Unless otherwise stated, this Agreement shall be for an initial period of 12 months,' after which it auto-continues until cancelled -- check your own signed Customer Agreement, which can state a different term.
- Cancellation: only by visiting the website and logging into the online portal at moxie.pestportals.com/landing/index. A cancellation received before a renewal term starts takes effect at the end of the current term; one received after a renewal has already started takes effect only at the end of the following term.
- Early-termination fee: 'an early termination fee equal to 80% of all service charges that would be due to Moxie' for the balance of the initial 12-month term, if either side ends the agreement early (other than a termination by Moxie 'for convenience').
- Price increases: Moxie 'may increase pricing upon 30 days' notice prior to the start of any renewal term.'
- Late payment: invoices are due on receipt; unpaid balances accrue monthly interest of 5% (or the highest rate the law allows, if lower), plus a $20 returned-check fee and possible collection costs and attorneys' fees; service can be suspended and the agreement terminated after 30 days unpaid.
- Liability cap: Moxie's aggregate liability for claims about its services under the agreement is capped at the amount actually paid by the customer, and it disclaims liability for injury or damage except where caused by its own gross negligence; the contract also disclaims responsibility for existing or future property damage, wood-destroying-organism damage, mold, or medical costs from insect bites.
- Complaints and a right to terminate: unresolved complaints about the quality of service must be sent by registered letter to Moxie's main office, 8404 Esters Blvd. Suite 100, Irving, TX 75063 -- and 'if Moxie fails to resolve any material complaint in a reasonable period of time, Customer may terminate this Agreement' provided payments for services rendered are up to date.
- Access, other providers, prior promises: if Moxie is denied access to the exterior it treats what it can reach and charges the full service fee (a return visit is free); the agreement says Moxie's obligations end if you let another pest-control company treat the structure during the term; and an entire-agreement clause states the written agreement supersedes all prior oral or written representations -- so a salesperson's verbal promise that is not in the signed agreement is hard to enforce.

Pricing is set per branch and is not in the Additional Terms; the company's branch pages publish starting prices such as 'From $159 /treatment' for Phoenix and 'From $149 /treatment' for Salt Lake City (checked 2026-09-27) -- your contract's own service charges are what the 80% early-termination fee is calculated from.
Separately, Moxie's marketing describes a re-treatment guarantee -- coming back at no charge if pests appear between scheduled visits -- while the Additional Terms itself is narrower, stating Moxie does not guarantee that treated insects will not return to the property. Door-to-door sales and telemarketing litigation
In 2024, a putative class action -- Ferrari v. Moxie Pest Control - Denver, LLC, D. Colo. 1:24-cv-02617, filed September 23, 2024 -- alleged Moxie made calls and texts to a number on the National Do Not Call Registry and continued after stop requests; the plaintiff said she had never been a Moxie customer and that the number belonged to her former landlord. The docket shows a 'Notice of Resolution' filed December 2, 2024 and a voluntary dismissal January 8, 2025 -- with prejudice as to the plaintiff's own claims, without prejudice to the putative class, each side bearing its own fees. A dismissal after a private resolution is not a court ruling on whether the underlying calling practices violated the law.
Moxie has separately gone to federal court, as plaintiff, against city ordinances regulating door-to-door sales hours and permits: against Marietta, Georgia (N.D. Ga. 1:21-cv-02926, filed 2021-07-21, a civil-rights challenge, ending in a stipulated dismissal June 13, 2022), against Port St. Lucie, Florida (S.D. Fla. 2:23-cv-14250, filed 2023-08-17, seeking a declaratory judgment, closed March 26, 2024 after the parties accepted a mediator's proposal), and against Mansfield, Texas (N.D. State pesticide regulators and local permit actions
These are actions by state pesticide regulators and local governments against specific Moxie branches or licensees, taken from the agencies' own published records. They concern licensing and solicitation rules at those locations, not a finding about the company nationwide.
Indiana (Office of Indiana State Chemist, 2022-2023). OISC case records published in the Indiana Pesticide Review Board packets show that on May 3, 2022 an inspector stopped a Moxie applicator who was not licensed and found that Moxie Pest Control Indianapolis LLC itself did not yet hold an Indiana pesticide business license; an Action Order told the branch to stop applications until licensed (case PS22-0104: a warning plus citations for applying pesticides for hire without a business license and for three unsupervised applications after the order). Two follow-up cases found that unlicensed or non-credentialed employees kept making applications after that order: PS23-0001 (a former employee reported making 85 for-hire applications in June 2022 while unlicensed; five counts; civil penalty $10,000) and PS23-0039 (565 unsupervised applications by five non-credentialed employees between mid-May and mid-June 2022; civil penalty $50,000). When the branch and its certified applicator, Garrett Davis, did not pay, OISC suspended the branch's pesticide business license and Davis's certification on May 15, 2023 (cases PS23-0140 and PS23-0141); the penalties were paid on May 25, 2023 and the license and certification were reinstated, and all four cases are marked closed. North Carolina (Department of Agriculture and Consumer Services, May 3, 2023). The N.C. Structural Pest Control Committee announced settlement agreements in which two structural pest control licensees for Moxie Pest Control in Raleigh, Fredrick Mullins ($1,200) and Tanner Nielsen ($1,600), agreed to pay for 'engaging in or supervising structural pest control work as a manager without having a valid license.' NCDA&CS press release.
Pennsylvania townships (2026). Door-to-door solicitation is permitted city by city. On June 4, 2026 the Horsham Township Police Department posted that 'all solicitation permits for Moxie Pest Control have been revoked due to repeated violations of our township ordinance' (Horsham Twp PD notice), and on July 24, 2026 Ridley Township posted that Moxie's permits 'were revoked for ordinance noncompliance' (Ridley Township notice). Other municipalities list Moxie among permitted solicitors, so the practical step is to check your own town's solicitor-permit list or police department when a salesperson comes to the door.
No state attorney-general action or class action about Moxie's auto-renewal or door-to-door contracts was found in the live sources checked for this page on 2026-09-27; that is a statement about what was found, not a guarantee that none exists.
Other litigation, in brief
Moxie has also been a party to employment and business-dispute litigation unrelated to consumer sales. Mayo v. Moxie Pest Control (Atlanta), LLC, N.D. Ga. 1:25-cv-04598, filed 2025-08-14, was a race-discrimination claim under 42 U.S.C. Section 1981; the parties jointly stipulated to dismissal and the clerk closed the case October 27, 2025, with no ruling on the merits. Walker v. Moxie Services LLC, D. Kan. 2:24-cv-02408, filed 2024-09-09, and Murray v. Moxie Services (Austin) LLC, W.D. Tex. 1:25-cv-00273, filed 2025-02-25, both ended in stipulated dismissals (April 28, 2025 and June 29, 2026). Murray was a Section 1981 race-based job-discrimination claim (the court granted in part and denied in part a partial motion to dismiss on August 15, 2025 before the parties settled their dispute by stipulation); the nature of the Walker suit was not shown in the docket metadata available for this page.
Separately, in a trade-secrets dispute where Moxie was the plaintiff, Moxie Pest Control (Utah), LLC v. Nielsen, D. Utah 2:21-cv-00240, filed 2021-04-19, alleged that employees of a competitor, Aptive Environmental, bribed Moxie sales representatives for confidential sales data. Moxie Pest Control is a real, operating pest-control business, not a fabricated identity. It holds a Better Business Bureau file (Moxie Pest Control, LP, Irving, TX; BBB-accredited since May 13, 2013; current rating 'A'), a published service contract, an active customer portal, and a documented litigation history spanning consumer, employment, and business disputes. None of that means every practice goes unchallenged -- see the complaint-pattern and litigation sections on this page for specifics, each attributed to its actual source rather than stated here as fact.

Is there a cancellation fee if I end my Moxie contract early?

Does my Moxie contract automatically renew?
Yes.
