On August 11 I received a phone call from Carnes Motor Company (Carnes) that the insurance on my vehicle expired. I immediately called the insurance company (as I thought the amount was automatically deducted from my bank account) and paid the delinquent insurance. Because I did not have a receipt of the transaction, I asked the insurance company to provide proof of insurance to the lien holder (Carnes). I also called the lien holder (Carnes) to inform them that the insurance was paid. Because the person I needed to speak to at Carnes was unavailable, I left a message. On August 13, my car was repossessed for not having insurance. When I called the insurance company, they informed me that I had insurance that began on the 11th. The insurance company then called Carnes and notified them that I had insurance that began on the 11th at 1:36 PM. After my message to Carnes and after having the insurance company validate that I had insurance, I still had to pay a total of $350 to get my vehicle back.
When arriving at Carnes on August 13th and explaining the information to them, they were extremely unhelpful and rude (too bad that is not against the law). They stated that I raised my voice and that because my voice was raised that they would no longer finance my vehicle. I had to pay the $350 to get my vehicle and they also made me pay the monthly scheduled vehicle payment (that wasn't due until the 15th of August).
Carnes Motor Company towed my vehicle although I met all of the requirements of the loan/contract. I was current on the loan and had insurance when the vehicle was towed. Also, I'm trying to find out if it is legal for Carnes to break a legally binding contract to finance the vehicle if they think I'm being disrespectful? It's simply ridiculous. These people have done this before to many others and I'm sick of them.
Also, they didn't actually tow my car. They DROVE it to their place of business and put trash on the floor. The radio station was set to another station that I don't listen to and I was down 1/4 a tank of gas. They are morons. I'm taking them to court and will take this as far as I possibly can through the legal system. People like them don't deserve to have a business.
