Will not honor 90 day defect warenty

I purchaced a new Holly carberator about 1 month ago, it had a 90 day warranty and for I had problems with the truck running after I installed it so I took it to a Machanic and after testing different thing found it to be carberator. He even called Holly and they agree something is wrong. But in order to rerurn the old one with all papers boxes and recipt, they say I MUST puchace a new carberator first then will refund me my money, this is even if I had the old one in my hand, I still would have to come up with the $320 befor they would warrenty it out? They say that is there pollecy. I do not have the extra 320 to purchace another just so i can return the defective one i have in my hands at the counter. After i purchace another one they can refund my money, but I already puchaced it once and now have to puchace another?
