Re: Renewal of complaint against Chuck Nash Jr. And Chuck Nash Chevrolet due to his breach of agreement, fraud, deceptive trade practices
Dear Ms. Flores:
I am respectfully requesting that you reopen your investigation of Chuck Nash, Jr., and Chuck Nash Chevrolet (see attached original complaint).
In response to my original complaint to you and to your letter to Chuck Nash, he agreed to correct all of the wrongdoings he had perpetrated against me. Accordingly we entered into a written agreement. Even though I complied with all of my promises, Nash complied with none of his!
Nash agreed to send a letter to the three major credit bureaus, and give them a list of the 31 unauthorized loan applications he sent and request they remove them-he did not do this. He sent a deceptively worded letter that did not identify any of the 31 applications to lenders. The credit bureaus have no way of knowing which applications were erroneous. This was malicious, deceptive and intentional by Chuck Nash.
Nash agreed to immediately send my license plates but he never sent them. He had originally attached license plates from another vehicle to my car (I was unaware) and I have been stopped by a Houston Police officer and cited for this.
Furthermore, Chuck Nash agreed to send notification of my monthly payments to any entity I directed him, yet he refused to do this as well.
Even though I have been making regular payments as we agreed to Triad Capital Corporation recently Chuck Nash conspired with several entities to sneak unto my property and tow my vehicle away! I have reason to believe Nash unlawfully invaded my privacy and accessed confidential records in order to locate and seize my vehicle. He also took my license plate from my motorhome and refuses to return it. I have sent letters, emails, and faxes to Nash demanding the return of my vehicle and my property and he has refused to respond.
Nash had no legal right to seize my vehicle. My contract with him stipulated that Triad Capital Corporation was the lender. Triad was the same lender I had agreed to in my original contract and I was sending my payments as agreed to them. (Nash told me he was the lienholder, but our agreement stipulated that Triad was, so after sending 1 payment to Nash because of false assertions by him, I began sending my monthly payments to Triad. Neither Triad nor Chuck Nash communicated to me in any manner that I had defaulted in any way, yet Nash repossessed my vehicle and refuses to communicate with me.
I have been seriously damaged by the outrageous and unethical conduct of Chuck Nash. He is a rich, arrogant man who has total disregard for honesty, fair-dealing and the rights of others. Nash thinks the rules do not apply to him. (He also has a criminal history).
One of the main reasons I purchased the car from Chuck Nash was that his finance manager, C... (my sister) told me it would boost my credit rating. Ms C... Obtained loan approval from Triad, (with the agreed-upon 1 application), I signed all loan documents and paid Nash $3,000.00. Then began making payments to Triad. Immediately following this, Nash brought in a new general manager, Scott Drake, who fired most of the sales staff with no reason or notice, including my sister. This generated hard feelings and Nash began retaliating against me apparently because I was C... Brother!
In October I had been disabled for six years but I was getting back on my feet and I was in the process of purchasing a chiropractic clinic. A bank had pre-approved a $90,000 loan based on my credit rating in October, which is the time I purchased the car from Nash. Contrary to my agreement with Nash that he would send only one loan application (which had already been approved) Nash maliciously sent out at least 31 loan applications in 1 month! As a result, my credit score dropped 27 points and fell below the minimum credit rating that was necessary to obtain the loan from my bank. As a result, the bank reconsidered and denied my loan. Consequently, I was unable to purchase the clinic. I lost all of my patients and I lost my chiropractic business! The malicious actions of Chuck Nash have devastated me financially.
