NCL Financial Systems Harassment, violations of Consumer Credit Protection Act

I received a phone call from John Case, who said he was calling from Citibank. He was not, he was calling from NCL/NCO Financial Services, a collection agency. He asked if my husband had received a Summons from the Racine County Court. I said not that I was aware (he hasn't), indicating a lawsuit has been filed and is pending. None is. He asked for a phone number where he could reach my husband. I said I didn't have one. He called me a liar when I said I had a phone number, just not one I was going to give him. He said I'd better call my husband and tell him about this debt.

Five minutes later, I got a call from my mother-in-law. Mr. Case had called her, too, with the same information. Told her of a debt, asked about a summons, etc. I believe there were several violations of TITLE 15, CHAPTER 41, SUBCHAPTER V - DEBT COLLECTION PRACTICES.

I called NCO and asked to speak with Case's supervisor. I explained what happened and said I wanted to lodge a complaint against John Case and his company. He agreed that what Case had done was fraudulent, illegal and he shouldn't have done it. Says that there will be ramifications against Case, and that he can pretty much guarantee that Case won't be employed there by the end of the month. He's only been there 2 months and mine is the second complaint of this same type against him.
He says we were probably paying off the debt with another agency, but then the account was turned over to them on june 30. They sent us a letter about it on July 2. He says when we get the letter, we should call him (gave me his direct extension) and we can set up a monthly payment arrangement.
Cunningham said he would be talking to his supervisor (Bagnison) and recommending terminating Case by the end of the month.

I also filed a complaint online with the FTC at www.ftc. Gov.
