In the fall of 2010 my husbands Uncle had passed away, he was very important in our life, our daughter was named after him, he had no children or a wife so we were his closest family. We had been making $100.00 a month payments until the death of our Uncle. My husband spoke with a person at this office who said they would note in the computer that the $100.00 would now be $50.00 untill we can get caught back up on our bills. Our home is in Idaho our Uncles funeral was in Michigan. We went to the funeral in September thinking everything was ok, they were accepting the $50.00 every month until the end of January when we recieved a WRIT OF EXECUTION now they have been garnishing my husbands paychecks since January. We have called and spoke with them time and time again asking to lower the amount of the garnishment, which is the maximum allowed, 25% of my husbands paycheck each time which is twice a month.
My husband is the only one who works, we have five children. I have been going to food pantries for food, driving a vehicle without current plates and tags to get the medical treatments needed for my children due to having no finances because of the garnishment. We have explained to these people over and over that they are putting undue hardships on our family and they never respond to us. On this Writ of Execution it says we owe a certain amount, now we are being told we have to pay some sort of sheriff cost and court cost. I do not understand alot of legalities but I do think the way they are handling this is not legal is it? After all they agreed to the $50.00 a month, they even cashed the money orders we sent them. Can they really continue doing this to our family?
