Illegally went into my bank acct, promised me tax savings ways to get my business going, all a big ripoff

My husband and I have been looking into the benefits of incorporating in preparation of purchasing a franchise business. We had been told about National Audit Defense Network (NADN).in seeking out information and to better educate ourselves we had made several telephone calls to NADN and spoke with Tim Erickson at (877) 623-# extension 1274.

Mr. Erickson appeared to be very informative on how best to go forward on becoming incorporated and saving on taxes. He informed us that for three thousand and nine hundred dollars my husband and I could become incorporated as well as have both our personal taxes and corporate taxes done for us.in addition we would have former IRS attorneys to assist us and answer any questions we may have during the first year of our corporation. He was very convincing in selling us on the idea that NADN would be holding our hand and teaching us everything we needed to run our business for the first year. He told us they would handle all the paperwork on getting us incorporated as well as would be helping direct and assisting us on getting business loans. He informed us that they would also make sure our corporate minutes were updated quarterly.

On September 3 we made the decision to go forward with NADN. I explained to Mr. Erickson that we would be rolling over our IRA's, which he assured us we would be able to write off any losses we may accrue.in addition he told us we would be able to write off the additional tax penalty we would have to pay due to early with draw. I let him know it would take ten business days before we would have the funds.in addition we requested to pay the $3,900.00 in two payments. He assured us this would not be a problem.

At that point Mr. Erickson got our chose of names for the corporation and informed me that to go forward he would need our banking information to proceed forward. However at no time would they attempt to withdrawal funds until we spoke and the funds were available. He then put a verifier on the phone to record all the information for record. The gentleman verifying the information now informed me the cost was not $3,900.00 but $3,995.00.in addition to this he informed me that they would be withdrawal funds on Friday, September 5.

This became of great concern to me and I questioned this as it was not the agreement Mr. Erickson and I spoke about earlier in our conversation. Not only did the cost go up $95.00, but also now the EFT was to take place in two days, which also was not the arrangement I made with Mr. Erickson. The verifier informed me not to worry about it, because it was just a formality and what ever Mr. Erickson and I had agreed upon would be how we would handle the transaction.

Knowing this did not sound right I asked to be put back on the phone with Mr. Erickson at that point. Unfortunately, the gentleman was not able to reconnect me to Mr. Erickson. This is when thing began to go wrong. I left several messages for Mr. Erickson over the next two days with on return call.in addition I sat on hold for a over ten minutes on multiple occasions in attempt to prevent NADN form attempting to withdrawal funds from my account. I finally made contact with Mr. Erickson on Friday, September 5. At which time he informed me they would not be processing the banking transaction with the understanding my husband and I were awaiting the funds from our IRA investments.

On September 12 I received notice from my bank that NADN had attempted to withdrawal funds on September 5 and 11. I immediately put in a stop payment request with my bank and filed my concerns with my financial institution, as well as made several calls to NADN. No one seemed to know whom Mr. Erickson was or how to assist me in getting this matter resolved.

On September 15 I spoke with Mr. Jim Burns, who identified himself as a Farm Manager. He appeared to be very concerned about the way things had been handled up to this point and assured me that he would assist me in getting matters resolved. He did inform me that if indeed NADN did illegally go into my bank account, which cost me NSF fees, they would indeed make it write. He asked me to put my concerns in writing and forward them to Mr. Robert Bennington. He informed me that he was an executive, and the person he would go to if he ever had a problem.in addition Mr. Burns promised me that he would walk my concern down to the client service department, where he would make sure some would contact me to get this matter resolved. I am still awaiting that call.

Being that the communication with in this organization lacks, and follow through is virtually non-expectant, I continued to be persistent in my attempt to get in touch with Mr. Erickson, which I finally did later in the late morning of the 15th. Mr. Erickson seemed to be very surprised by the fact that they had indeed attempted to withdraw funds from my account illegally. However, he would make sure that this was made right. He told me that her would definitely refund the $81.00 that I was now out due to NSF charges and the stop payment fee.in addition I request a letter that I could present to my bank explaining the problem NADN created. He assured me he would make matters right. Mr. Erickson called me back later that afternoon and informed me that a Brian in the client service department would be calling me before 4:00 that afternoon to let me know that would be crediting my account back the $81.00, as well as providing me with a letter for my bank.

Wanting to believe that NADN was going to redeem themselves I awaited a call from the client service department. Unfortunately the client service department never contacted me. However, Mr. Erickson did call me around 3:00 that afternoon to let me know that he would reduce the price from $3,995.00 to $3,695.00. I then asked for all this to be in writing and e-mailed.

During this conversation Mr. Erickson was very persistent in the conversation to make sure the funds would be available on Friday. I at no time gave an authorization to fund a purchase of NADN service. He informed me that he would be in touch with me the following day.

On September 16 Mr. Erickson called as he stated he would. I explained I was not happy with his service, nor the NADN as a whole, and that I would not be going on with there service. I explained I still expected to be paid back the $81.00 as well as receive a letter from him to provide my bank. Mr. Erickson was still attempting to win me back. I let him know that if he got me the let and $81.00, as while as references I would consider. This has yet to happen.

Mr. Erickson did fax me a letter finally on September 18, which I have included a copy of. This letter is completely unacceptable. It does not say anything regarding the illegally attempt to with draw funds nor the $81.00 to be paid back.

It is my hope that NADN make matters right and send me a letter of apologize as well as send me a check for the $81.00 I have lost due to the complete incompetence and lack of customer service.
