Account hacked and Wamu charges me fees

On my way to the doctors I had to fill up my car, I go to the pump, stick my card in, enter pin, then it says 'card cancelled'. I try again and the same thing, so I called my wife to let her know to check out what is going on in our account. When I get home she tells me that we have about a dozen $25 and $100 electronic checks in our account, plus a lot of overdraft fees. We are overdrafted close to $1,000. We locked our account so nothing more could happen to it.

My wife called to find out what was going on and to dispute the charges, which they said would take 3-4 weeks. So we waited a few days and my wife noticed that some of the electronic checks disappeared off teh account record. So she called to find out what was going on, they said they investigated and found some fraud, but that some of the charges were legit. They were also going to reduce some of the overdraft fees.

A week passed and we then get a call from Wamu saying we have to bring our account current or that we would go into collections. My wife said that we were told some of the overdraft fees would be taken off, she was then told that taking those fees off were 'at their discretion', and if they did that it would only be after we brought the account current. The electronic checks that are remaining they say are ones we did ourselves, that we came into the bank and did this. Which we most certainly did not. The last time I was at the bank was a week previously to deposit my disability check to cover our bills, which promptly disappeared with all these electronic checks.

They say the bills that came through, and we were overdrawn on are valid overdraft fees, even though they only happened because of the hack. Real classy WaMu.

Now we are getting calls about our account being overdrawn so much and treating us like criminals. Oddly enough this happened right around the time that 19,000 WaMu employees got laid off. Considering they say that the electronic checks came from within the bank, I'm thinking someone got upset and decided to mess with WaMu and instead hit innocent victims like my wife & I.

We now have a credit union account, but we still have to deal with WaMu to clear this whole thing up. With them treating us like criminals, this is not going to be fun, nor easy. Merry bloody Christmas. Its a good thing we do not have children because this has ruined everything for us. I've been off work due to disability for a year now, my wife works from home but doesn't make much and to pay off that $1,000 would mean no food or bills get paid for a month, which we certainly cannot do.
