Reporting Foreclosure not Short Sale

In March we sold my house in a Short Sale, this was after months of struggling to pay the mortgage and after eight months of forbearance (all paid on time, but not reported so... But that's another story). This was fully agreed upon by Citi-Residential and myself and working through a Realtor we were able to actually sell it at a reasonable price that Citi-Residential agreed upon.

However in July I got my Trans Union credit report and it had not a Short Sale, but rather "Foreclosure - Collateral Sold." I started an on-line investigation and they came back saying that their investigation found no changes.

I sent them a letter explaining that it was a Short Sale, that no Foreclosure occurred, and that they were reporting it wrong. I included a copy of the County Record showing the sale and full payment of debt from the Title Company.

Again they came back with the same form letter, no changes. This one, as the last one, stated I could include a 100 word statement to go with my credit report on record.

This time I called my attorney. She informed me that they were legally bound to give me the information that was causing this Foreclosure notice to be on my record, in other words the court docket number for the lawsuit. I wrote them again, this time repeating what my attorney said but also including a copy of the document signed by Citi-Residential stating that the report should state "Foreclosure Redeemed - Short Sale - Account Settled in Full" which proved no Foreclosure went through. I also added in a 100 word statement about this false claim against my record.

And yet again they wrote back, same form letter, the only thing they did was add the statement. I am about to take the next step in informing the BBB and State's Attorney's Consumer Advocate to get this cleared up and my credit appropriately noted.

I have yet to check Equifax or Experian, but wanted to warn people how TransUnion is literally destroying people's lives by this type of inaccurate reporting. As many credit counselors or attorneys will explain, a Short Sale is a heck of a lot less destructive than a Foreclosure and at this point with this report my family has zero chance of getting a home again when we're able unless this is fixed!
