I also have a auto loan with WFS. The original contract was for a new Pacifica but 2 months after I took delivery of the car it caught fire due to a defective factory part.
Well, to make a long story short my Insurance Company paid their value and I had GAP Insurance which I was told would cover any deficiency balance due. Unfortunately it did not cover about $4300. So at that point some one from WFS contacted me and said that I owe them and if I did not pay they would take my home.
They informed me that they could rewrite the balance due under a new contract and spread it over 36 months. Sounded ok until I got the contract in the mail. The interest rate had tripled to 18%. At this time I was sick and on disability and was unable to think clearly. They also said that the loan had to be rewritten with them and I could go nowhere else. They had me I thought at the time.
Well having no other source of obtaining the money I signed it. That was my first and last mistake with these people.
Now I have gotten sick again and fell behind 2 months. I pay them every month now but it is not good enough for them and they won't re-age it to catch it up. Late charges are $25 each month and they call me constantly every couple of hours (each time its a different person) to find out when I will pay next even though they were paid a monthly payment a few days ago by phone. It has gotten to the point where I don't answer anymore, but I did today. They told me that I was not trying hard enough to pay my obligations, that I should not have been approved at all even though my FICO was over 700, and if we do not get another payment within another 4 days they will sue me and take my home.
I Have since contacted the Attorney General in NC and am in the process of filing a claim against them.
