Fraude, deceptive trade practices, and I am filing with the Attorney General's office

I just wanted to say that I too have gone through the ringers with Option One. I financed my new home in Oct. 28 of 2007. The lies started before we even closed. They lied about the first day of payment due in writing. Then they messed up on how much we were financing, etc. I had to correct their errors 4 times before close.

Then, like suckers... We closed. I noticed that Option One made a hefty fee off of us on top of the ARM that we got. Then when we looked over our paperwork from closing, we saw that dates and interest rates had been changed from what we had signed prior to closing and from then on it has been a battle. We set up an escrow account, to which our monthly payments were supposed to collect taxes and insurance from the get go.

We had never been late as we made electronic payments, or so we thought. They said our first payment was due sooner than we had originally signed for, which put us in a strain, but we paid before 30 days were up every month, including late charges... BUT NEVER 30 DAYS LATE!

Well, last month, Option One decided that they wanted to collect a full year of escrow on TOP of our regular payments and assess it as a payment due all at once. We made regular payment electronically as we always do last month. They gave us a confirmation date and code, but refused payment because they wanted the entire escrow account paid in full as well. Now, they are saying we are late, plus we owe the escrow. They harass us by calling 20 times a day.

When I ask to speak to a customer service supervisor, I get a machine every time no matter what time of day or how often I call. When i ask to speak to someone who speak English or is in the United States, I get a machine every time. Always with the same message for both... No one is able to help me at this time, call back later. But it does not specify when and what their hours are to call back. Representatives lie and give me false names like Joe and Sue and they are in India, live and work in India, and I ask them what their real names are. They refuse to answer.

I called the Texas Attorney General's office today to file a complaint against them and found out that this year alone, they have 26 complaints filed in Texas that are under investigation. I am sure that other states have more.

I am seeking a mortgage lender who has a good reputation so I can refinance before my credit is severly damaged because with the rate Option One is going, I am sure they will not wait until the ARM matures to try and grasp my home. My credit was fair before and we have made payments on everything on time that we purchased so i am sure we can find someone who will let us refi.

If anyone wants to seek a class action against Option One, let me know please. I am seeking legal representation because Option One's fraudulent actions clearly show that they have violated our contract, and possibly laws pertaining to mortgage lending. I refuse to lose my home to a company like this. Just because they make more money than me doesn't make them right.

Please contact me if you wish to seek a lawsuit against these people. I believe there is also someting I read about lawsuits from complaintants who are in different states, perhaps with the FBI even. Together, our voices are stonger than if we take them on one at a time. They do not understand the law, they do not understand compassion, they do not understand truth, but they do understand one thing... Money. We can take back what is rightfully ours. Our homes.
