I was served a summons 9 days ago, and I'm tring to figure out if my debt is out of SOL or not. SOL in Louisiana is 3 yrs. Last activity on my account was Oct. 8 2004. The summons was filed into court in August, but I did not recieve the summons until Nov. Does it go by when the summons was received or when it was first filed into court? I am also trying to figure out if they are actually registered in Louisiana. I called the Secretary of State office, and they said they weren't, because they are not suing me under Midland Credit Mgmt, they are suing me under Midland Funding LLC. Do they need to be registered under both names? Any help would be appreciated. Thanks.
