On August 1999 my wife and I received a statement from Ocwen telling us that we were two months default. Immediately we call our Mortgagor holder Wilshire Credit Corporation. Who told us that they did sold our loan to Ocwen since June 1999. We asked then where was the payment for June, July that we sent to then "Wilshire" they told us that they forward the payment to Ocwen.
When we contacted Ocwen they told us that they didn't received any payment from Wilshire, therefore we must send then payment for July & August by Western Union in turn they will call Wilshire for June payment.
O September 1999 we received a phone call from Ocwen saying that Wilshire didn't know what they did with June payment, therefore they want us to resubmit the payment through Western Union.
But on December 2,1999 a nightmare begin we were served with a Summons and Complaint for the foreclosure of our home for 9 years from the law firm of Hunt, Leibert, Chester & Jacobson, P.C. Immediately we call the law firm, we spoke the Attorney Richard Leibert who stated that his "partner's" Ocwen Federal Bank FSB acquired our mortgage note in a Portfolio of homes targeted for strict foclosure. Therefore Attorney Leibert directed us to file pro se appearance, and then his "partner" Loan Consultant Sleiman Chams from Ocwen Federal Bank aka Sal Chams, will look at our records of monthly payments and withdraw the action.
On December 8,1999 Ocwen Loan Consultant, Sleiman Chams faxed us a Forbearance Agreement. We told him that we didn't need a Forbearance Agreement. Mr. Chams told us that we have only two options forbearance or foclosure. We told Mr. Chams and their Attorney's at Hunt, Leibert, Chester & Jacobson, P.C. That our mortgage was not default. Mr. Chams told us, to agree to the condition of the forbearance, which is a full down payment of $4,150.00 in certified funds with a stated reinstatement amount of $9,120.28 and a principal of $127,100.00 That was the only way we could stop the foreclosure. We refused to sign the agreement, because $127,100.00 was the original amount that GMAC had financed on December 28,1990.
Therefore Ocwen Loan Consultant Sleiman Chams and their Attorney's at Hunt, Leibert, Chester & Jacobson, P.C.initiated a barrage of discrimination, harassment and intimidation phone calls to force us to enter into the forbearance agreement and reinstatement figure from Hunt, Leibert, Chaster & Jacobson, P.C.
We look for Justice from the court. But didn't happens, instead, for a year and a half we successfully struggled pro se in Court preventing the strict foreclosure. We received phone call from Ocwen Loan Consultant Sleiman Chams telling us that we were monorities leaving in a neighborhood that we don't belong. Since our home is situated in a white neighborhood. Therefore he suggested, that he could sold our home for more then what we owed in turn he will make sure that we get the equity and go settle in a neighborhood "more suitable for our own kind."
O May 8 the Cousel Bridget T. Cusack filed an appearance on our behalf. Thereafter, Ocwen and their Attorney Hunt, Leibert, Chester & Jacobson. P.C. Requested transfer of the case from our home town Bridgeport to the Complex Litigation Docket in Waterbury. Ocwen Attorney's at Hunt, Leibert, Chester & Jacobson, P.C. Tried to get a competency evaluation against Counsel Bridget to have her disqualified from the case. Since she was the only one who want to help us.
From the beginning of this matter we were told by Ocwen Loan Consultant Sleiman Chams and their Attorney's from Hunt, Leibert, Chester & Jacobson, P.C. "if is the last thing they do, they will make sure. They foreclose our home and throw our children and us in the street. Because we don't have the resources and money to fight them off. We are minorities leaving in a white neighborhood.'
