I had closed a loan on Jan. 05. I was employeed at the time as a branch manager in Staten Island, NY. We were bankers and closed this loan as a correspondent lender, Mr. Saeed was the underwriter on this file. He reviewed this file and gave me the clear to close! We closed this loan, Nomura was suppose to buy this loan off our warehouse but did not like the way this loan was underwritten.
There is no Law that states the employer is allowed to keep this commision nor have the rights to charge me any cost for the mistake of an underwriter. The banking law is if there was fraud in the file the employer has the right to keep commision from loan and can charge employee any cost occured, and call the proper authorities!
This loan nothing to that nature nor did I over look anything, I got my clear to close from the underwriter!
