I called a debt collector that was trying to contact me by leaving a name and number with my mother's answering machine on several occasions. He never mentioned that a debt was owed, just wanted her to contact me. I finally called him. He was pressuring me into making a phone check payment during the call. He also wanted me to make payment arrangements then.
He asked what I would consider to be a fair payment amount, and I said $65 a month just like I had been paying regularly on the Circuit City credit card. He said that was "unacceptable" and I HAD to agree to a one time lump sum of just over $800 or 3 monthly payments of equal amount. He also said that a judgement had already been filed against me. If I had a judgement entered against me, I would have recieved papers from the county I live in. He also said if I didn't want to pay now, to hire a lawyer because I would lose in court and also have to pay court costs and other fees.
After finally getting him to back off on the phone payment, I told him I would see what I could arrange. He said to call him before 4pm on Thurs. Or before noon on Friday or else he would take further action. Is this acting within the laws of fair collection practices? I THINK NOT! If they are doing the same thing to you, let's get together and turn the tables on them!
