Tribute, CompuCredit never investigated my dispute

I really had no problems with Aspire in the beginning but my husband was having issues with Tribute not crediting his payments to his account. We did some investigating and found the 2 accounts were the same company. It wasnt long after that when the problems with my account started. I had an unauthorized charge I disputed. I followed their procedure for disputes exactly as they outlined on their site and submitted it via mail. I saved a copy to my computer as well.

After 3 weeks I contacted them and they had stated they never received my dispute so I asked them where I could fax the dispute because I was running out of time to dispute a charge. They stated there wasnt a fax number for them. Then they stated that there was no way for me to contact the dispute department and through all this I was hung up on numerous times.

After finally getting the dispute initiated, it was about another 3 weeks that I contacted them again to find out the status of the dispute and I was told there was no dispute on file for my account and that my account had been closed and the balance in full was due immediately. I had just about had enough at this point and contacted CompuCredit directly in Atlanta and asked for the individual or department that handles Aspire and kind of described my issue to them.

They were no more helpful than Aspire was and I was told that the dispute was still pending and there was nothing they could do. It has now been approximately 4 months since the dispute and I still have no resolution. According to the FDCPA, disputes must be resolved within no more than 45 days of being initiated and if they are not then the charges in question may be removed.

My account was closed and $145 was in dispute and then on this month's statement, I am now overlimit and have an overlimit fee. How is that possible when the account was closed so there cant be any new charges on it and it is also known that a company cannot charge you an overlimit fee if it is their fee that causes you to be overlimit. Even if it was their fault on that I shouldnt be anywhere near my limit. So I am totally lost as to whether I need to contact the Federal Trade Commission and pursue this or should I just pay the balance to salvage my credit???
