Ripoff request to payoff loan run around for two months and no pay off

We are Katrina Disaster victims in Louisiana. Our home was damage by winds and water. Our insurances companies pay us for the damages in October. The checks were sent to Option One Mortgage Loss Draft Department for signatures and instructions.

The check for the wind damage was sent back to us for all other signatures in November. The check was mailed back to Option One with a letter of intent to pay the mortgage off. Confirmation by tracking number from UPS says Option One received the check and our letter of intent 12/8/05. After phoning them, speaking to several different departments they verified that the receipt of the letter and check.

Phoning and emailing on several more occassions to confirm when the pay off will happen no one could give us a define answer. The monies from the check was put into our loan information on 12/13/05 according the current loan informatin detail report that can be access via internet.

We phone the same departments again one person from customer service told the pay off process will be completed by 12/23/05.

On 01/04/06 we received an email asking for another letter of intent to pay the loan off from the Customers Resolution Department We fax and mailed (01/04/06 and 01/05/06) another letter along with a copy of the first letter and a copy of UPS tracking information to show the receipt of the first letter. No payoff as of 01/06/06.

No Flood insurance received as of yet it was mailed 11/09/05 by option to us for signatures but never received it. We called the insurane company and stopped payment and reissued per Option One.

According to Option One a new check was issued and mailed to us on 12/27/05. We by their direction on 12/08/05 requested the check be overnight on but now they say that request must be in writting with a charge of $6.00; after calling to inform them we have not received the check as of 01/04/06. A supervisor from the Loss Draft Department called back on 01/05/06 to inform us the check was sent in the regular mail on 12/27/05.

Mind you the wind damage insurance check was for $149,215.92 and the flood insurance check was for $22,619.15. We received a payoff amount in November of $134,392.30, so what is the problem.

We are unable to live in our home so we have been paying to live in an apartment. We are retired and the balance due us after the loan payoff would be the monies we intent to use to get our house in living condition again.
