On January 25 My husband, Jason Warren, and I went to Gary Mathews Automall in Jackson Tennessee. We were looking at getting an used vehicle. We ended up getting a 2001 Dodge Intrepid.
When we went to fill out the paperwork our salesperson told the finance person to offer us the five year extended warranty. The finance person asked us if we would like the five year extended warranty. We said yes. It was added to our payments. Nothing was explained about the warranty at this time.
We signed the papers and everything was great until November 3. We took our vehicle in because it was making a funny noise. I explained to Nancy Bailey (who tagged it in) that we had extended warranty on the vehicle. Nancy explained to me that they needed to find the problem then turn it into the warranty company. After that it would be a hundred dollar deductible.
They later called Jason Warren saying they did not find anything wrong with the vehicle and wanted Jason to authorize more work. He asked if warranty would cover it. Nancy stated she was almost positive warranty would they just had to find the problem first. After 999 dollars worth of cost to take apart the motor we were asked to turn in oil receipts. We did not keep them and Jason notified Nancy of this, that no one had told us anything about keep them. This was the first time we had heard about it but we would try to find them.
After a few weeks of searching we were only able to come up with one. During this time my mother-in-law also called Nancy Bailey and talked to her about the warranty. Nancy stated to her she was ninety-nine percent sure warranty would cover it. We turned in the one receipt we had. We then called back a few days later and they said a warranty guy was coming to inspect the vehicle.
After about a week we then called them several times again and we were told that warranty would not cover the vehicle because it had "long term sludge". Jason asked Nancy how it could have long term sludge when we just bought the vehicle in January. Jason asked how much it would cost to have the vehicle fixed. Nancy said it would cost 7 thousand dollars. We still owed 12 thousand on the vehicle.
We decided to try to trade it in. They would not let us trade it in since we had not had it long enough and we did not have enough equity in the car. Jason then talked to Nancy to see if there was some way we could make payments on the thousand dollars we already owed them. Nancy said no and that they would now charge us 10 dollars a day for storage.
Our finance company (GMAC) when they heard about all fo this also called Gary Mathews advising them it would be in everyone's best intrest to fix the vehicle and release it back to us. Gary Mathew's Automall still refused. When I went to pick up a carseat out of our vehicle I had looked in the trunk and also noticed they had laid our dirty motor parts in the trunk without any plastic or anyting under it.
Our car has now been repoed and we still owe 12,000 on it. Gary Mathews is also now saying that they never said they were almost positive or 99 percent positive that warrany would cover it. My mother -in-law is also writing the BBB letting them know exackly what was said to her and that in fact this was said to her. We also find out after looking over our warranty papers that is was not a 5 year warranty but approximately 3 years. No one told us about any of this. We were deceived and left completely in the dark.
We have been left without a vehicle since November. No one will do anything about it. To hire a lawyer would cost too much for us. We have lost our only vehicle. Thank you for your time.
