Mr. Eric Bers refused to complete the work he has done on my house that was poorly built. My house will be going on 3 years old on December 8. I've been thru Consumer Affairs which has to subpoena Mr. Eric in his office and he had his attorney, Mr. James L. Mayer, Esquire attend.

I had to paid an attorney which I wanted to go to court because I felt that the issues appointed would give me a better chance, but the builder was hiding behind a binding contract with arbitration. I had to paid for another home inspection, attorney, arbitration fee of $450.00 to find out that everything was to late to file.

I did contact the Residential Warranty Corporation 5300 Derry Street, Harrisburg, Pa 1711-3598 within the year until now, but I was told a lot of these issues were too late to submit. This is not true because I have documentation that was within one-year.

This house had screens with paint on them, two kitchen screens have holes in them, the windows and the carpet were dirty, because Eric but my house back on the market without my knowledge even though he had a large sum of money as a down-payment he was not giving back unless the court advised him. At settlement he charge me close to $2,000.00 for not settling on time - which was a lie.

Going down toward the basement there is a soft spot on the wall, the small window in the family room has no lock-bolt, and is off the center allowing air to blown in.

Also there is no window screen. The laundry room - a washer and dryer cannot fit in. Eric knew I wanted a larger room so that I would also have a storage room. I paid extra for.

Well, my washer and dryer will not fit and if it did, I have no choice but to wash out in the hall way. The hook-up is located with the water heater under the steps with a room no bigger than 2x4. The Pacesetter Home Specification shows exhaust fans in the bathroom he puts in windows and tell me it meet Howard County Code.

I had no idea Eric was putting in windows in place of exhaust fans-why a contract. None of the bathrooms contain a bath accessory package. There is no double basin kitchen sink. Pacesetter Home Addendum A 4 0f 5.

He states that I sign the drawing where the sink was going. I did but it did not say a single sink, I was going by what the contract stated. The 2nd floor near the step line the wall needs to be re-caulked. The driveway is cracking and there are large holes underneath Driveway. The driveway is in front of my house right up to the front porch, and it was to be on the side of my house. This driveway takes up my front yard and leaves me with walk-way and part of my front yard.

The contract called for so many feet of walk way. He put down a cement walk-way which he said was an up-grade from the blacktop which I did not ask for. I would have prefer the blacktop because the cement driveway is a job from HELL. The back porch needs to be re-built there is nothing supporting it, the porch is currently being held up by a cement block, and an old broken piece of board placed there by the builder.

In the bedroom on the lower level the half window is off center and their is no way to lock i. Also there is no screen in this window. A sliding door was to be in the back on the basement level, instead there I a BULKO DOOR that is out of whack, there are also cracks on the cement surrounding the door. I'm very upset with this door - Eric stated that he only promise me a back door and that's what I GOT.

As the contract shows there were to be two sliding doors one for the Dining Room and the other for the Family Room. He took the drawing but my initials up there and cross out the door. This has been an argument since I was aware of it. I brought my own front door which cost me $845.00.

Eric placed a dent in the door and refused to fix it. Also t settlement he was to refund me the replacement of the door since I got my own front door. He refuses to give me the $15.00 at settlement. The paint is of very poor quality and comes off easily. The paint is also peeling.

The back door towards the kitchen can't be open when the door to the basement is open, if these doors open at the same time they will collide with one another. The Arbitrator could see this was a builder issue, but he refuse to accept this item.

Also the wall in the Living Room paint is peeling and you can see that he doesn't have sheet-rock but a white painted plywood. I had this house basement finished so I do not know what kind of walls I have.

The closet wall has no support behind it. Master bedroom shelve came out of wall left large holes in wall. This closet had just screws in wall and no support - he just bang in screws wherever and would not come out to fix.

The front door entrance light panel is placed on the wrong side of the wall therefore you have to shut the front door before you can turn on the outside light. When you go downstairs from the kitchen you have to turn the light on from the opposite side of the door.

It seems everything is done backwards. The master bedroom where there is another bath - the shower wall on your right side is slightly crack. There is much more, but it just make me sick to keep writing different agencies with no help only for the builder.

I have even wrote Home Association, BBB they do not get involved with Builders. Maybe this is why they can do whatever they want, even the Home Association would not get involved. It's all about the MONEY not the CONSUMER.

I was even ripped-off by my lawyer, Mr. C. Michael Brawshaw - Crofton MD. He lead me to believe after this arbitration was over either way, He would help me to take Pacesetter Homes to court after he got the arbitrator report he decided to let it stand and if I wanted too I could get a second opinion.

Well, guess what he already got PAID UP FRONT. The more you fight the more money you LOSE not the BUILDER. That's why there are less court cases with BUILDER'S or CONTRACTOR's. Mr. Eric L. Bers waited ONE DAY BEFORE CLOSING TO SUE ME.

What kind of Builder is he, I'll let you decide. As of 11/09 he is building more homes one down the street from me. The funny thing is every time he builds 2 or 3 homes, he never have the same contractor's.

A lot of the contractor will not work for him anymore. I wonder why. I almost forgot out in my back yard and on the side of my yard my grading looks like something out of the Twilight Zone. I see huge holes forming up - like something underneath is trying to come up. Also my back yard is always very wet, I just hope it do not come into my basement.
