Breach of Contract

I bid on auction lot #603027610 for item HP Touchsmart 600-1305t Intel Core i3-370M 2.4Ghz 4GB 700GB 23" on 5/6. The auction listed the item as "In Stock: 1", and at 7:40pm on 5/6 I won the auction. Within the hour, I entered my payment information. 3 days later the Bid Details page showed my order (#B11776534) status as "In Warehouse". On 5/11, I sent an email asking for an update. I sent another email on 5/13. Three days later (5/16), after no response, I called their support line and spoke to a Customer Service rep, who told me that the item was "at the warehouse" and they had no other information, nor could they contact the warehouse.

On 5/19, I sent yet another email, and on 5/20 I called again. This rep told me the same, but added that this particular item was backordered, and there was no due date. When I asked to speak with a supervisor, I was told that there were no supervisors, yet after putting me on hold, came back and said that the supervisor (!) was going to go to the warehouse in person and find out what was going on. But said that I could not speak to that supervisor because she would only tell me the same thing. Later on 5/20, I sent an email to Ms McDonald that BBBOnline listed as the Customer Service Supervisor. Later that day, I got two emails from [email protected], signed by "LaShonda M" stating that "inventory discrepancies" occur and that they were "looking for a substitution" and to allow a few more days. On 5/21, I received another email from LaShonda that there was no expected date and to keep checking the website for updates.

My biggest issue here is that they advertised the item as "In stock" and then suddenly it was not. Since they consider my bidding as a legally binding contract to purchase, they should also be held to that "contract". I have heard no more from them, and the item is still listed as "In Warehouse". The day after I lodged a BBB complaint, they canceled the order!

Don't ever use this SCAM SITE! I fairly won a bid, and per THEIR rules, this is a CONTRACT. The item was listed as "1 IN STOCK", yet after I won, the item magically disappeared. After three weeks of emails and phone calls, I entered a complaint with the BBB, and the very next day, UBid cancelled my transaction. If the bis I entered was a contract, then by definition, the contract MUST have 2 parties, so UBid has breached the contract to provide merchandise. No explaination forthcoming. These people are crooks. Don't use them (nor RetTag, as they are the parent company) and warn anyone you know away from them.
