Homeside Lending is obviously ripping all of us off and I just realized it!
Let me explain. My husband and I bought our house 6 years ago, actually, my father owns the house, but he did this for us. We originally had another morgage company, but shortly after we moved in, Homeside took over the loan. They have done exactly what all these other people are claiming. And imagine having to explain to your father, that you are in fact making your payments, they are just sending them back to you, and telling you to send in one lump payment at the end of the month.
For example, my husband was recently laid off of work. We have been struggling daily just to survive. We received notification on August 16 (letter was dated on August 12 that we have 30 days from the date of the letter to send them $1,437.27. We knew that we had gotten behind, and were just desperate to do whatever we had to do to keep our home.
My father is quite upset, see this is his credit at stake. On September 5 I sent a certified check in the amout of $1250.00 and 2 days later did a speed pay check in the amount of $200.00 which totals $1450.00 - $12.73 more that was demanded in the "forclosure proceeding" letter that we had received. We also recieved the HUD information that other people mentioned on this website about Homeside. We mailed this in plenty of time to meet our 30-day deadline.
The next thing I know, my dad shows up at my door very upset because he had now received a "FORCLOSURE PENDING" letter. He shows up because we have spent my ENTIRE paycheck for the month on rent and had gotten our home phone disconnected. We are in pitiful shape now. This is a "FINAL NOTICE" letter and says that we now owe $2,134.80 which we definately don't have. So, I call and try to get an explaination. I knew that the $200 on-line payment had been deducted because I follow my bank account closely.
You do that when there isn't much in there. They begin to tell me that they obviously mailed the $200 check back to me (a check cut from HomeSide); and the $1250.00 is in route to me (to my father)... I am just dumbfounded. So, in the meantime, I have tried to pay my balance in full and they receive one more late fee for the month... And I have gotten more of a payment added to my next month's bill in the process. My father is well aware of this website now, and whatever he/we need to do to become involved in this class action suit, please advise me.
I am tired of being hassled with mailing payments to Atlanta, GA, Texas, Florida, etc. As well. HELP!
