Refusing to pay claim on accident which was the fault of the other person that is insured with safeway

I was in a accident with someone that is i insured with safeway ins the 3-tickets were given to the driver 1. Owi 2.inproper backing 3. No drivers lic. The insured was in the car she was to drunk to drive safeway in dening my claim saying the driver was not on her insurance policy to drive the car.

The accident was sept 18 the driver was brought to jail.
