I worked for a company called CALEX stationed out of PA. While working for then the safety officer Jim Fowler added three untrue items to my DAC reprt. These items appeared on there only AFTER we had a falling out and I quit. I never knew these items were on there until going for another job and being told they were there.
The first incident happened almost 7months prior to me leaving. I supposedly hit a building and caused damage. The incident was reported to Mr. Fowler the day after I was there with my delivery. I was unaware that this had even occured until Mr. Fowler called me and presented it to me. While I was there being unloaded (approximately 1 hour) no one approached me, nor were the police involved. Calex never made a payment to this company but there it is on my DAC report.
The second incident occured again about 6 months before I left. This incident was not handled properly. I was accused of hitting a parked truck. The owners of the company came out of the building while I was being unloaded and looked around the side of my truck to see the truck that was parked nexted to me. They then went inside and got a higher up and the police were called saying I hit that truck. I was issued a ticket which I was found not guilty of. The courts believed I did not hit that truck. But the company went on to sue CALEX and Mr. Fowler decided to settle out of court. Mr. Fowler put this supposed accident on my DAC prior to any descions from either court.
The last incident was a preventable accident. I was at a gas station and my truck tires spun on oil and disel fuel and I hit the telephone pole. Again this happen about 5 months prior to me leaving and it ever being reported on my DAC report. I was issued a ticket which again I was found not guilty and it was closed. But it still appears on my DAC reprt.
These three incidents are not on my license and I have no points on my license. But due to these false accusations on my report my career as a driver is done. When trying to fix these errors I was told several things. Mr. Fowler told me he could put anything he wanted on my DAC report and I couldn't do anything about it and I should be glad he didn't make them DOT reprtables.
I am currently trying to fight these allegations but have been unable to find a lawyer who handles fight with DAC. I have filed a rebuttle but most companies don't pay attention to that and I need to have these situations erased so I can continue my career. I can only wonder haw DAC and the companies that report to DAC can live with the many lives they have ruined with thier lies and false statements. Isn't there anyone who can help the truckers who want to work???
