I replied to email after contacting uneedapart.com that this website referred MIDWEST (MAR) to me as having a low mileage transmission for my cuatomer's 2000 528i BMW. I called on 12/10/07 and explained I needed trans very quickly, and also explained I would base my decision to purchase from MAR over other responders on speed of delivery, the guarantees they emailed me with / (also toted on their website that MAR's customers could not offer) OF CARFAX AND DYNOTEST specifically FOR THE CAR AND TRANS (from here on out called "guarantees") THEY SAID THEY HAD IN STOCK AT THEIR LOCATION, and that the mileage would be verified as 31,000 miles. And shipping tracking, all for the cost of total of $1245 if paid for with credit card or bank debit card and would be shipped to arrive in 3-4 days from the day of payment. We found a trans actually cheaper, but it could not be shipped in 3-4 days, nor would it have the carfax, dynotest, and tracking guaranteed via the email MAR intially sent us, touted on their website or aggreed to provide as part of the purchase.

We did pay with our debit card 12/10/07 and funds were removed 12/11/07. We looked for the trans and guarantees on Friday 12/14/07 and emailed and called for tracking info after trans did not arrive. Our second call to MAR we were told it already was shipped and we got the tracking via email. A few rude sentences later from MAR in that SAME phone converstation telling us we should be getting everything by this evening, William who later id's himself as Shaun. And Dewayn over several condescending conversations they directed at me and my wife, that I had to sign a "cc (credit card) verification
form and that we were foolish to think that MAR would ship until they got paid. My wife and I pointed out that we had paid, NOT with a credit card, but our debit to get the trans shipped out the same day as aggreed by MAR on 12/10/07. We confirmed that on 12/14/07MAR says they could not ship untill they got paid, but that the funds had been removed by Midwest 12/11/07 and that meant their explanation held no water.

WEll, they insisted we still had to sign the CC form, although we pointed out it did not apply since it was a form, not a contract and did not apply since we used a debit card. And they had already got their money!
My wife insisted I not sign this, but under MAR's bully tactics and my customer's rental car bill going up, rather than have another conversation to be abused my MAR, I signed it just to get the shipment done. This was the OLY time we used the debit card in December, and I very seldom use it during the year, and I just signed a form with all my bank and identity info on it!
Well, we kept getting that A) the trans and the guarantees, and the shipping info had ALREADY arrived, and then in same phone call (long distance at our expense of course!) that on monday that they were here already then told would be here wednesday, then on wednsday were hear already, then told they wouldbe here Friday. And so on. My wife put off a job with her K9 (drug dog) to be here to help me get trans unloaded and installed ASAP since exhaust, and getting it on a trans stand requires two people. I got ONLY trans, not the guarantees on 12/26/07 and got up at 3 am to get trans in per ALLDATA specs provided directly by BMW after flushing and replacing seals. I had several hours labor, my lift not making income for several days since MAR promised it was here already, then would be here monday, wednesday, friday etc.

I called MAR and explained I had NOT got the guarantees, the tracking and used ALLDATA procedure which is expensive prescription service and world recognised and that trans had no pressure and was not good. MAR told me that they had another trans. I again told them time was a issue, and that we still wanted tracking and the guarantees we did not get with the first bad trans. I asked MAR how quick would we get this one, and their reply was they had the second IN STOCK at their location, and would shipp it out that day (12/27/07) and we would see it in 3-4 days. After MAr assured us of this, we asked about the bad trans and MAR told us they did NOT want or need the first one back, and they would be sure to get the replacement out THAT afternoon. Well, another round of "you already got it, then in the same converstation it will be there monday. Then wednesday then friday and my lift is STILL not making money and my customer is still in a rental. ON 01/11/08 after a few emails and calls looking for the 2nd promised in 3-4 days supposedly shipped 12/27/07 with guarantees, MAR became more verablly disrespectfull, and my customer is now ready to have his car towed from here to another shop to get it fixed, and sue us. MAR cryptically ended the call with the cryptic unprevoked reminder that THEY had our bank information. My wife immediately called our bank to make them aware that MAR might try to debit our account again, only to find that aftr we signed the CC form with MAR, that our account had been emptied, seriously overdrawn by several thousand, and also that my CD had been drained.

ALL of this specifically after under duress signing the CC form MAr forced us to sign, and that being THE ONLY time we had used the debit card. WEll, we had to file with the police, all our credit agencies and have had our account (which we pay billa and buy parts with to do business) locked down and us now without a dime.

I and my wife called 1/14/08 to inquire about replacement trans again to get even worse response from MAR. After telling us all had been delivered, several
calls later, we were told that MAR now (even though they assured us we already recieved it in same phone call a few sentences earlier. Would NOt ship the replacement untill we shipped the bad one back! We told MAR we would ship trans back and expected a full refund since they failed to fullfill their contact in a month and a half and our customer was going to seek other means and did not need theirs anymore. We were told we would recieve our refund in about 5 days. Well we purchased supplies, palleted and took the bad one to carrier to be returned, all at our own time and supplies expense. MY wife and I called 01/21/08 to inquire about
our refund, and were told that MAR had already refunded us! I asked how they did this, and they said they refunded via our debit card (remember this account was closed due to thefts) and our bank confirmed a refund had not even been attempted. Well I and my wife called again, and apon being told we had been refunded (again) pointed out that was impossible.in the last of same conversation that MAR saying we already had refund, then they told us that we had to prove we did not improperly install the trans and that it was our fault it was not good and this delayed refund.

I use Alldata, world recognised, and have OVER 36 years high end auto repair at dealerships, and military machanic retired with rank proving my ability to properly install this trans per BMW specs/procedures. My wife called, after the final accusatory email referring to me as mechanically inept to install the trans, on 01/25/08 at 4pm to make a last inquirey on a amicable refund. The MAR person whom aswered the phone id's himself as "William" and when she asked about the refund, he told her "William" handled that and was at luch and to call back in a hour". She asked why he would be going to lunch at 4pm? Well, she called, as instructed, back 2 minutes to 5 pm to discover that MAR was closed.
Well it seems the delays, the deception, and the crude tactics have left my customer with a rental car woe, me without a trans and the guarantees that we paid for, my lift unproductive for 1.5 months and apparently my credit and accounts comprimised from that 12/11/07 giving of my debit info and MAr's co-ersion to force me to sign all my credit info away on the cc verification form" (although I did not pay that way) which may be related to my bank thefts, and a customer seeking resolution for somthing I DID not do/cause and tried politely to resolve.

My wife, whose job, and sometimes her life, depends on documenting facts while working with her K9 partner, has thoroughly recorded EVERYTHING thru our computer, txtxtommyatyahoo and ALL the shipping documents, receipts for fluids/seals dated to correspond to their use on the first trans install, and can easily provide reliable witness as to MAR failing to provide ANYTHING we paid for, and their deception, and unwillingness to feel like they can be prosecuted for this. You can bet your last dollar, if you believe MIDWEST, your story will be they took you too!
Please contact me, if you want justice. If we do not get a FULL refund, I will at least see to the best of my ability that everything I can do to warn others will be done, and will continue to be done. My wife, like her K9, has a good bite and will stay on top of this untill we get our money back.

ALl of this is my statement of my opinion, and has not of yet been proven in court, and should be taken with that in mind. MY documents represent true facts and that should be taken in mind also. BEWARE! DO Not give them your credit or debit info, and warn others please!
