If Jack Simony has a fiduciary responsibility to report his finings or concerns to his investors regarding Scott Rosteins actions, why did he not and is there really a legal issue regarding such a finding?

The suit includes numerous potentially damning emails from managers of the hedge funds — including Meir "Mark"
Nordlicht and Jack Simony — that indicate they had knowledge that Rothstein's investment scheme was fraudulent beginning after the Ponzi suffered what one of the scheme's insiders termed a "meltdown" in April. Does anyone have a copy of this complaint?
After all it is clear that Scott Rosteins scam is that of his own but you would think Simony being in the industry knew better but how does one go about proving that? I guess it just comes down to a trust issue in a his own circle. Have there been any sort of findings by the court or a prosecution of Jack Simony for his reaction?
