York Financial Group of Oviedo Florida in conjunction with TitleCorp of Florida coerced us into signing closing documents via mail which we did not get to peruse. They rused the doucments same day of closing 4/27 and requested we sign, get notarized and return the same day. They pressured us telling us if we did not sign them we could will have to pay a penalty or even loose our deposit. Titlecorp did not give us enough notice to be physically present. Called 2 days before and said closing will be on 4/27/06. They knew in advance that we lived in Ft Lauderdale and the property is in Orlando and needed enough time to coordinate
time off work etc to be there in time.

They denied any extension eventhough they delayed the process and failed to give us enough notice. Our original contract stated we will get to do a walkthrough 30 days before closing. They denied us walkthrough since they did not give us any notice of closing we did not get to do the walk through.

York Financial was told we did not want any Variable Loan and prepayment penalty but when we signed the documents because we did not get the time to read doucments but was focused on signing to return notarized same evening after we signed we realized that York
had tricked us and had tucked into the loan a prepayment penalty and a variable loan.
So we understand now why they rushed the documents and threatned us with we could loose the down payment. Damion of Title Corp the closing company said, this as well as Brian Ivy of York.

The other issue the realtor Eddie Rivera Keller William Realty said the developer will credit us $5000.00 if we used their financer which was York. So we did, however we ended up paying more at closing than what was on the Good Faith estimate. I do not recall seeing that credit on closing. We have asked repeatedly for them to send the doucment which showed how and where they credited that amount. But to date no one has sent it. It appears that York increased the closing.
The property cost $193.900.00 we paid ten percent down.in the end we paid a total of
$28,575.00 after the entire process. The other thing York gave us poor advise to benefit the bank only - they gave us a HELOC Home equity loan on the newly purchased property and no interest loan. They wrote 2 loans instead of one. Speaking to our banker and other financial companies this was a very good way of ripping us off. Not good for consumer only bank. We have excellent credit and other properties and could have done better with our bank but York was dishonest with us. I have a faxed note
which reiterated that we did not want a variable loan and was not too keen on the HELOC. Would have preferred one loan which would have been cheaper btu they told us some
info about no PMI if we took interest only loan.
NOw we would like York to have the bank they
choosed for us to rewrite the terms of the loan, no prepayment, no variable, no heloc and show us the credit of the $5000.00. The terms should have an interest no higher than the 7.25 they wrote on the 5 year loan.
The Good Faith Estimate estimated closing $7,435.00 but we ended paying much more so where was the $5,000.00 credited and how come we paid more to close than if we had used our bank.

There is another person Elaine Canton who
signed a contract with The Crest to purcahase a condo, gave the deposit of $10,000.00 and to date 7 months later, York and the
Realtor cannot tell her when she is closing and she wants her money back - 7 months her number is 340 277 9328,340 690 1292. I also understand that many others who used them at that developer had problems.

It should also be noted that Rick Collado was the initial person who started the loan process once he left no one from York called us and that was how it was until close to closing.

I feel it was unfair, dishonest, and we should get justice.

After all it was their delay of the closing, they could have extended the closing date or if they had given us the 30 days notice as said in the contract for the signing of the purchase od the document with Eddie Rivera it is all their fault.

Closing means all parties must be thre to understand the terms and is clear on what they are signing. They coerced us, rushed up and tucked in the terms of loans we signed for because of that.
