We applied for a refinance mortgage on 10/28/04, at which time we told the the loan officer Drew Hudson that we were in a chapter 13 bankruptacy.
We were told that it was no problem they could work with that On 11/8/04 at 4:38: 50 PM, were told on the phone and on their web site, I have written documentation that we were approved. We had our home appraised which we paid for. Drew Hudson said the only step left was to have the chapter 13 dismissed and to fax him that paper and we could close our loan. He called us every day sometimes 3 & 4 times a day, also Jennifer Bell the processor made numerous phone calls to us, to get the dismissal papers from the courts.
We had it dismissed and faxed the paperwork to them. We were told we would settle before Christmas, that they would send someone to our home. As we got closer to Christmas, there was no settlement date. Then we were told we would settle before the end of the year. Well we are now in 2005 and we still have not settled. We could not get a straight answer from anyone. Having released the 13 the current mortgage company was after us. I e mailed Jennifer Bell and told her we needed to settle becuase if we didn't we were going to lose our home. Then all the wheels starting turning. We received phone calls from Jennifer's boss Carol and Drews boss, Mark Hogan. It seems as though Drew Hudson, had never gotten the payoffs from the 1st and 2nd mortgage company along with any histories that he needed.
Mark Hogan told us that Drew is a "good" loan officier, but he would get lazy and forget to do things, and that he wished he had seen our file prior to us being told to release our chapter 13, which we never should have done. We started receiving letters from attorney's that our house was going to foreclousure, because we released the 13 and had not refinanced. Mark Hogan took over the loan, and we went from a 8% interest rate to a 11.5% and finally we received a leeter from Home Loan Center saying that we were declined a loan.
Our home that we have lived in for 8 years is due to be auctioned on March 3, and all because we took Home Loan Centers advise to dismiss our chapter 13 "That was all they needed us to do to settle our refinance". They lied to us, they gave us bad advise and then they dumped us because we did what they said was necessary to refinance our home.
