TikTok's U.S. Terms of Service (last updated July 15, 2026) name TikTok USDS Joint Venture LLC as the operator of the platform in the United States, and its newsroom describes the venture's ownership and board. BBB shows the TikTok file as not accredited and not rated, with the complaint and review counts given on this page. Federal and court records show a 2019 FTC child-privacy penalty of $5.7 million, a 2022 class-action settlement of $92 million with final judgment, and a $400 million Justice Department settlement announced on 21 August 2026 that states there has been no determination of liability. Whether a particular account action, charge or Shop order was handled correctly depends on the facts of that case.

BBB's raw page data gives file opened 2019-01-30, business started 2017-01-01 and incorporated 2015-04-30. BBB lists alternate names BD TikTok USA LLC, TikTok Shop and TikTok USDS Joint Venture LLC, so the file is not limited to the app. BBB notes that complaint volume should be read in light of the company's size.
- Trustpilot (tiktok.com): 1.4 from 4,559 reviews; the profile is shown as "Unclaimed profile" and Trustpilot states that it does not fact-check reviews.
BBB also displays "This business has 1 alert", a "Government Action" titled "FTC vs TikTok", which relates to the 2024 Justice Department/FTC complaint described on this page (allegations).

Banned or restricted account. TikTok's Help Center page on content violations and bans says: "Your account status reflects your violation history across TikTok over the last 90 days. Your account status can be Healthy, Fair, Severe, or Banned."
More detailShow less
It also says that a notice about removed content explains the reason and how to appeal if you think a mistake was made. Section 5.2 of the Terms says TikTok reserves the right "at any time and without prior notice, to ban or suspend your account, or restrict your access to features of the Platform, at our sole discretion" on listed grounds, such as a belief that you violated the Terms or Community Guidelines. Keep screenshots of the notice, the date and the stated reason before you appeal in the app. The same page says: "If your account is banned, you can log in to the account to submit an appeal and download your personal data", and adds that TikTok deletes personal data after a period of time under applicable laws and its data retention policy.
Deleting an account. Section 5.1 of the Terms says that if you delete your account the Terms end as an agreement, except for obligations that by nature survive. TikTok's account-deletion help page gives the in-app path: Profile, Menu, Settings and privacy, Account, then deactivate or delete account.
Disputes with the company. Section 8.1 of the Terms requires an informal resolution step first: the party raising a dispute notifies the other, and the receiving party has 60 days to respond, before either side may file legal action.

The Terms name TikTok USDS Joint Venture and "TT Commerce & Global Services" in this section. Section 8.2 says claims are governed by the laws of the State of California and are to be "resolved exclusively in the U.S. District Court for the Central District of California or the Superior Court of the State of California, County of Los Angeles". Section 8.3 states: "YOU MUST INITIATE ANY PROCEEDING OR ACTION WITHIN ONE (1) YEAR OF THE DATE OF THE OCCURRENCE OF THE EVENT OR FACTS GIVING RISE TO A DISPUTE". Section 8 contains no arbitration or class-waiver wording (read on 2026-10-20); read the full Section 8 before relying on this summary.
TikTok Shop orders. BBB lists "TikTok Shop" as an alternate name of the TikTok file. The TikTok Buyer Policy linked from the Terms (last updated date: March 26, 2026) says each Seller "determines their own shop policies including those for cancellations, returns, and refunds". Under "Reporting a Problem" it says: "If you have a complaint relating to a product, you should contact the Seller directly. You may also reach out to our customer service team at [email protected]", and that "TikTok is not a party to any dispute between you and Sellers." Check the return and refund details shown on your order in the app.
Other routes. BBB accepts complaints about TikTok through the profile's "Submit a Complaint" link. Federal and state consumer agencies, including the FTC and your state attorney general, also take consumer complaints.
Federal child-privacy actions: FTC 2019 and Justice Department 2026
2019 FTC order (Musical.ly). The FTC said on 27 February 2019 that "the operators of the video social networking app Musical.ly, now known as TikTok, have agreed to pay $5.7 million to settle Federal Trade Commission allegations that the company illegally collected personal information from children", calling it "the largest civil penalty ever obtained by the Commission in a children's privacy case" at that time. The complaint was filed by the Department of Justice on the FTC's behalf under the Children's Online Privacy Protection Act (COPPA).

2024 complaint. On 2 August 2024 the FTC announced that the Department of Justice had sued TikTok, ByteDance and affiliated companies in the U.S. District Court for the Central District of California (case 2:24-cv-06535). The FTC press release says the complaint alleged violations of COPPA and of the 2019 order, including collecting personal data from children under 13 without parental notice and consent and failing to honor parents' deletion requests. These were allegations in the complaint.
2026 settlement. On 21 August 2026 the Justice Department announced a $400 million settlement "with TikTok, ByteDance, and affiliated entities". Under the settlement TikTok "will pay $300 million immediately and an additional $100 million upon entry of an order vacating a prior consent decree entered against TikTok's predecessor, Musical.ly". The release states: "The claims resolved by the United States in the settlements are allegations only, and there has been no determination of liability." It also says that since the 2024 complaint TikTok "has undergone significant changes to its ownership, management, compliance functions, and privacy practices".
Court status as shown on the dockets (2026-10-20). In the 2024 case the court recorded a joint stipulation of dismissal and dismissed the action with prejudice on 24 August 2026. In the 2019 Musical.ly case, the minutes for 21 September 2026 record that the court denied the government's consent motion to vacate the 2019 stipulated order without prejudice, and that the parties would meet and confer about a renewed motion. Because the $100 million payment is tied to an order vacating the 2019 decree, readers should not assume that payment has been triggered.
Court record: federal child-privacy cases and the 2020 privacy class action
In re TikTok, Inc., Consumer Privacy Litigation (N.D. Ill., 1:20-cv-04699, MDL No. 2948). The final-approval opinion dated 28 July 2022 describes a class settlement with "a $92 million settlement fund, as well as broad injunctive relief", after 1,215,541 valid claims were submitted by the March 1, 2022 claim deadline. The court entered its order and final judgment granting final approval on 22 August 2022. An objector's notice of appeal (Seventh Circuit No. 22-2682) was dismissed on a voluntary-dismissal motion by order of 12 October 2022. The opinion records that the defendants deny the alleged conduct; consult the opinion for exact settlement terms.

United States v. ByteDance Ltd. (C.D. Cal., 2:24-cv-06535) and United States v. Musical.ly (C.D. Cal., 2:19-cv-01439) are described in the federal actions section.
State attorney general matters. On 25 September 2026 the Alabama Attorney General announced a settlement with TikTok Inc., stating that Alabama "will receive a minimum of $100 million, due to the state within 45 days, with the potential to receive up to $300 million if certain conditions are met" and that the agreement "resolves Alabama's claims that TikTok designed its platform with addictive features, knowingly exposed young users to serious mental harms, and intentionally misled the public about the safety of its platforms"; those were the state's claims. The release lists required features including a two-hour daily time limit for minors, access restrictions from 12:00 a.m. to 6:00 a.m., age assurance measures, a default non-personalized feed for teen users and a prohibition on cosmetic filters for teen users. This amount is a separate matter and is not added to the Justice Department figure.

Who operates TikTok in the United States
TikTok's newsroom, in an announcement dated January 23, 2026, said: "Today, TikTok USDS Joint Venture LLC has been established in compliance with the Executive Order signed by President Trump on September 25, 2025". The announcement says the board appointed Adam Presser as CEO that day. Per that announcement the venture has three managing investors, Silver Lake, Oracle and MGX, "each holding 15%", and "ByteDance retains 19.9% of the Joint Venture". It is governed by a seven-member, majority-American board. The company says U.S. user data and the recommendation algorithm are to be secured in Oracle's U.S. cloud environment, and that the venture has "decision-making authority for trust and safety policies and content moderation". The same announcement says TikTok global's U.S. entities manage product interoperability and certain commercial activities, including e-commerce, advertising and marketing.
The U.S. Terms of Service and Privacy Policy, both last updated July 15, 2026, name TikTok USDS Joint Venture LLC as the U.S. operator. Earlier regulatory and court records on this page (2019 FTC order, the 2020 privacy class action) concern the operators of TikTok and Musical.ly at the time, including ByteDance-affiliated companies; we have not assumed which entity bears obligations under those orders today. The company says it serves more than 200 million Americans and 7.5 million businesses (announcement of the venture).
