New York's 23 NYCRR 1 regulates collection conduct statewide but does not itself require a statewide license. New York City's DCWP requires a Debt Collection Agency license for any agency collecting from NYC residents, including a debt buyer, regardless of whether it owns the debt being collected -- licensing there turns on where the consumer is, not on debt ownership. The City of Buffalo licenses certain collection-agency activity under City Code Chapter 140, and that ordinance does include an exemption for entities collecting only debts that are exclusively their own -- but the company's own site states it does two distinct things: it purchases debt portfolios outright, and separately recovers "receivables purchased by our clients directly from the original creditor," meaning debt owned by its clients, not by the company itself. Buffalo's exemption, if it applies at all, would only cover the first activity; collecting on debt its clients own would not qualify for it.
