Hims & Hers problems: cancel a subscription, stop a charge, get a refund, escalate (checked October 11, 2026)

Check the next order date first. The company's Help Center says to discontinue a subscription "at least 48 hours before your next order date" and that the next process date is visible in the online account (article updated August 25, 2026). The Terms and Conditions (last updated August 31, 2026) say a subscription will automatically renew "unless you cancel at least two (2) days before the applicable renewal processing date" and that the first renewal "may be charged early" and later renewals "up to two (2) days early".

How to cancel (company's own steps). In the Hims or Hers app: profile icon, Subscriptions, Additional Options > Manage Subscription, Discontinue plan > Cancel Subscription, then follow the prompts. On the website: log in, Subscriptions tab, Manage, Additional Options > Manage subscription, Discontinue plan > Cancel Subscription. The article notes that cancelling "does not cancel an order that is already processing or has shipped" and that each subscription is cancelled separately. The Terms also say a subscription can be cancelled "in-app or through your online account under 'My Subscriptions' by contacting the Customer Help Center ... or by calling 1-800-368-0038"; the Help Center cancellation article points current and former subscribers to the secure messaging portal in the account and does not list a phone number.

Weight loss membership. A separate article (updated August 26, 2026) says to open Subscriptions, select the weight loss subscription, Manage subscription, and "Turn off auto-renew on my medication or membership". It says cancelling the membership also cancels associated medications, that access continues to the end of the current billing period, and that cancelling only the medication leaves the membership active and billed monthly. The Terms say that on cancellation the member will not receive "any unshipped medication". The company's homepage footnote (opened October 11, 2026) says the Weight Loss Membership is "$39 for the first month, auto-renews at $149/month thereafter" and that the membership "does not include or guarantee a prescription"; prices and terms can change, so read the checkout screen.

Refunds and returns. The refund article (updated August 27, 2026) says changes must be made "at least 48 hours before payment is processed" and that "we can't guarantee a refund once the pharmacy has processed your order". The Terms say "We do not offer refunds for partially used subscription periods, although we may provide refunds on a case-by-case basis in our sole and absolute discretion." The return-policy article (updated August 1, 2025) says "we are unable to accommodate returns" because of the nature of the products and invites customers to contact the company if dissatisfied.

Weight loss refunds (Terms, last updated August 31, 2026). The Terms treat weight loss separately from the general refund article above: "Your first month Membership fee is non-refundable." and "Refunds for partially used Weight Loss Membership or Medication Plan periods are not guaranteed and may be provided in our sole and absolute discretion." They also say "You will not be eligible for a refund for any medication after it has been shipped." and that a Medication Plan refund is given "only if (1) for an initial order, you cancel your Medication Plan within 48 hours of submitting your payment information; or (2) for subscription renewals, you cancel your Medication Plan two (2) days before your next billing renewal date." The Terms add that cancelling the Medication Plan does not cancel the Weight Loss Membership, which keeps renewing until cancelled. The Terms list [email protected] and 1-800-368-0038 for these cancellations; the Help Center article quoted above points to the account messaging portal. Both are the company's own pages and are shown side by side.

Arbitration and opt-out. The Terms contain a binding arbitration and class-action waiver provision ("unless you timely opt-out of arbitration"). They say a customer "can opt out of this Arbitration Agreement within thirty (30) days after first becoming subject to this Arbitration Agreement" by sending a signed notice with name, residence address, email address and a clear statement to "Hims & Hers Health, Inc., 2269 Chestnut Street, #523, San Francisco, CA 94123, ATTN: Arbitration Opt-Out". Read the current Terms for the full conditions before relying on this summary.

Billing disputes and charges you do not recognise. The company's route is a message to the care team through the account's secure messaging portal (the Help Center says it does not support live chat; a provider or care-team member replies later). If that does not resolve a charge, you can dispute it with your card issuer or bank, and you can file a complaint with the FTC at ReportFraud.ftc.gov, with your state attorney general and with your state's medical or pharmacy board for clinical or dispensing concerns. The FTC's July 2026 complaint, described in the regulator section, alleges that many consumers were charged and subscribed shortly after submitting an intake form; the company disputes the claims in its SEC filing.

Medical or side-effect questions. Use the secure message portal for your provider (company article "How do I contact my healthcare provider?"); for an emergency call 911. Adverse reactions to a medication can also be reported to FDA MedWatch.

Privacy requests. The Help Center directs privacy requests to privacy.hims.com ("Make a Privacy Request"); the Privacy Policy (last updated September 17, 2026) also lists [email protected] for do-not-sell or share requests.

Regulator and advertising-review actions: FTC, Utah and California complaint (July 2026), FDA warning letters, NAD decision, and company-reported HHS referral and SEC investigation

FTC, Utah Division of Consumer Protection and Los Angeles County (July 29, 2026). The FTC, joined by the Utah Division of Consumer Protection and the People of the State of California acting through Los Angeles County Counsel, filed a complaint against Hims & Hers Health, Inc. in the U.S. District Court for the Northern District of California (Case No. 3:26-cv-07871). The FTC's press release says the complaint alleges that the company "shared consumers' sensitive health information about medical conditions with third-party advertising platforms despite claiming its services maintain consumers' privacy" and "deceives users about its billing and cancellation practices". Specifically it alleges violations of Section 5 of the FTC Act and of the Restore Online Shoppers' Confidence Act (ROSCA); Utah alleges violations of the Utah Consumer Sales Practices Act and California alleges violations of its False Advertising and Unfair Competition Laws.

As the press release summarises the allegations: consumers who submit an intake form are asked for billing information and, the FTC alleges, are most often charged and enrolled in a subscription plan without a provider consultation or a chance to review the treatment; the company allegedly does not clearly disclose refill dates; cancellation was, before 2023, mostly by phone, email or chat, and after online cancellation was introduced the button was allegedly hidden until users chose "add/remove items from order" and navigated several steps; and consumer health information was allegedly shared with Meta, Snap and other platforms through customer lists and tracking "Events". The press release notes the Commission vote to file was 2-0 and that "The case will be decided by the court". The complaint seeks a permanent injunction, monetary relief and civil penalties. These are allegations; no court has made findings.

The company's position. Hims & Hers Health's Form 10-Q for the quarter ended June 30, 2026 says it received an FTC Civil Investigative Demand in October 2023, that "settlement negotiations with the FTC ... were unsuccessful", that it "believes it has meritorious arguments and intends to vigorously defend", and that it had recorded a legal contingency accrual of approximately $60 million for the matter as of June 30, 2026, which "may decrease or increase materially". The accrual is an accounting estimate stated by the company, not a finding.

The company's newsroom page "Our Commitment to Privacy" (opened October 11, 2026; it does not mention the FTC case by name) says: "From day one, we built our platform with a focus on transparency, informed decision-making, and a deep respect for the privacy of the people we serve." It also says the company separates "information that patients share with their healthcare providers from marketing activity" and configures "technologies to prevent the transmission of protected health information". This is the company's statement of its position and is shown alongside, not as an answer to, the pending allegations.

FDA warning letters (September 9, 2025). FDA's Center for Drug Evaluation and Research sent two warning letters, one to "Hims & Hers Health, Inc. dba Hims" (MARCS-CMS 716567, website hims.com) and one to "Hims & Hers Health, Inc. dba Hers" (716825, website forhers.com). Each says the site offered compounded semaglutide and that the claim "Same active ingredient as Ozempic and Wegovy" (the Hers letter: "Weekly injectable GLP-1 with the same active ingredient as Ozempic and Wegovy") and "Clinically proven ingredients" were false or misleading under sections 502(a) and 502(bb) of the Food, Drug, and Cosmetic Act, so the products were misbranded; the letters asked for a written response within 15 working days. The company's 10-Q says it received these warning letters.

FDA statement and company-reported HHS referral (February 2026). On February 6, 2026 the FDA announced "its intent to take decisive steps to restrict GLP-1 active pharmaceutical ingredients (APIs) intended for use in non-FDA-approved compounded drugs that are being mass-marketed by companies — including Hims & Hers and other compounding pharmacies". The company's 10-Q also reports that in February 2026 the General Counsel of HHS stated on X that HHS had referred the company to the Department of Justice for investigation for potential violations of the Federal Food, Drug, and Cosmetic Act and Title 18 provisions, and that "it is unclear what actions the FDA, HHS, or DOJ may take". No DOJ charge or filing was identified in the sources checked on October 11, 2026. The 10-Q says that in March 2026 the company shifted its U.S. weight loss offering toward branded GLP-1 medications and now offers compounded GLP-1 products "on a limited scale".

BBB National Programs, National Advertising Division (August 24, 2026). In a challenge brought by Kenvue Inc. about compounded topical hair-loss products sold under the Hims and Hers names, NAD (a self-regulatory advertising body of BBB National Programs, not a government agency) determined that the company "provided a reasonable basis for its comparative efficacy claim" that finasteride gives better results when paired with minoxidil than when used alone, and recommended that it modify that claim to remove the "doctor trusted" language. NAD recommended that the company modify or discontinue other claims: the unqualified "doctor-trusted ingredients" claims, the claim that the products contain "dermatologist-recommended" ingredients (discontinue), "safe and effective" research language, and side-effect statements that could suggest local scalp reactions are the only material risks. NAD says the company permanently discontinued several claims on legacy Hers Spray webpages during the proceeding. The decision summary quotes the company's advertiser statement that it "voluntarily agrees to comply with NAD's recommendations." NAD recommendations are not court orders or government findings.

Other items the company reports. The 10-K says that in February 2026 the SEC's Division of Enforcement notified the company that it had opened an investigation and asked it to preserve documents about its public statements regarding compounded semaglutide and related business relationships; the company says it is cooperating and cannot predict the outcome. The 10-Q says the company's Outsourcing Facility received an FDA warning letter in December 2025 about an adverse event report and related procedures, to which it responded, and that Australia's Therapeutic Goods Administration issued compulsory notices to Eucalyptus subsidiaries before the company acquired Eucalyptus in June 2026, in an investigation of 2023 and 2024 advertising; the company says it is indemnified by certain warrantors for losses from that matter.

No additional state or local government enforcement action was identified in the sources checked on October 11, 2026.

Who is Hims & Hers: entity, brands, how the service works, acquisitions and the cyber incident the company disclosed

Entity. The SEC registrant is Hims & Hers Health, Inc., a Delaware corporation whose Class A common stock trades on the NYSE as HIMS; SEC records show it as formerly Oaktree Acquisition Corp. until January 2021, after a merger agreement with Hims, Inc. dated September 30, 2020. Its 10-K says the company is a "consumer-first health and wellness platform" and that the trademarks HIMS, HERS, H, HIMS & HERS and ZAVA are material. Websites listed in the 10-K include hims.com and forhers.com. The company's Help Center footer reads "(c) Hims, Inc."; this page treats Hims, Inc. as the former private company name and BBB-listed alternate name, not a separate business.

How the service works (company's description). The Help Center says a customer fills in an online intake form; "a healthcare provider will assess your case and determine the most suitable treatment option"; depending on the state, the consultation is asynchronous through secure messaging or requires a video visit; treatments are then shipped. The 10-K says that, because most states prohibit the corporate practice of medicine, clinical services are provided by separate "Affiliated Medical Groups" owned by licensed physicians under contract, and that the company also owns pharmacies. Prescription products require a subscription (Help Center, updated August 27, 2026).

Scale and acquisitions (company filings). The 10-Q reports 2,891 thousand subscribers at June 30, 2026, using the company's own definition of subscribers on subscription billing. The 10-K and 10-Q report acquisitions of Zava (July 2025, UK and EU), Medici (November 2025, Canada), YourBio Health (January 2026) and Eucalyptus (June 2026, Australia and other markets). A Form 8-K shows Apostrophe Pharmacy LLC and XeCare LLC as subsidiary sellers in a receivables purchase agreement with JPMorgan Chase Bank of July 1, 2026.

Cybersecurity incident. The 10-Q says that in early February 2026 the company identified an incident in which an unauthorized third party gained access to certain systems through a social engineering attack on two employees, that it contained and investigated it with outside advisers and law enforcement, and that it "completed the required regulatory and individual notifications". The 10-Q does not state in that passage what data was involved. The 10-K (filed February 23, 2026, while the investigation was described as ongoing) says the company confirmed that its customer service software platform was accessed, that "the vast majority of customer information accessed was limited to personally identifiable information (PII), specifically, names and email addresses, and less frequently phone numbers and physical addresses", that for customers who contacted customer service between mid-February 2025 and early February 2026 the third party "may have gained access to customer data regarding category of treatment and other information included in their communications with customer service", and that "Our electronic medical record was not accessed." These are the company's statements. A consolidated class action about a data breach is pending (see the litigation section).

Litigation record: FTC case, consumer privacy and data-breach class actions, securities and patent suits

FTC et al. v. Hims & Hers Health, Inc., No. 3:26-cv-07871 (N.D. Cal.). Filed July 29, 2026. The CourtListener docket (opened October 11, 2026) shows reassignment to Judge Vince Chhabria; an order of August 17 denying motions to seal and ordering Hims & Hers to show cause; an August 24 text order stating "The order to show cause is lifted. If Hims files another sealing request that is remotely this overbroad, sanctions will issue."; an unredacted complaint filed August 18; a show-cause hearing set for August 26 that was vacated on August 25; a waiver of service with an answer due September 28; an initial case management conference set for October 30, 2026; and later entries through October 9 (stipulations, related-case orders, administrative motions and ADR certifications). No ruling on the merits was identified.

Doe v. Hims & Hers Health, Inc., No. 3:26-cv-07941 (N.D. Cal.). Filed July 30, 2026. The 10-Q describes it as a putative nationwide and California class action based on "substantially the same underlying facts alleged in the FTC action", with claims under the Electronic Communications Privacy Act, the California Invasion of Privacy Act and the California Confidentiality of Medical Information Act, among others; the company says it will defend vigorously. The docket shows related-case orders and a September 21 filing to appoint counsel and consolidate cases.

In re Hims & Hers, Inc. Data Breach Litigation, No. 3:26-cv-03077 (N.D. Cal., Judge Charles R. Breyer). Opened April 10, 2026. The docket shows an August 10, 2026 order consolidating cases and appointing interim co-lead class counsel, a consolidated amended complaint filed September 3, and a September 24 order extending the defendants' time to respond. The claims are not described in the sources opened; the company's separate 10-Q disclosure of a February 2026 cybersecurity incident is summarised in the company background section.

Securities and derivative suits. The 10-Q says two putative securities class actions filed June 25, 2025 were consolidated as In re Hims & Hers Health, Inc. Securities Litigation, No. 25-cv-05315 (N.D. Cal.), concerning statements about the company's relationship with Novo Nordisk during April 29 to June 22, 2025, and that three shareholder derivative suits are stayed; the company does not consider a loss probable. These concern investors, not customers.

Novo Nordisk patent suit. Novo Nordisk filed a patent infringement complaint over compounded semaglutide in the District of Delaware on February 9, 2026 and, per the 10-Q, "voluntarily dismissed all claims without prejudice" on March 9, 2026, reserving the right to refile. The 10-Q says the court closed the case; a voluntary dismissal without prejudice is not a ruling on the merits, and the 10-Q describes none.

CourtListener's search for the company name on October 11, 2026 also returned other 2026 consumer-filed dockets in several federal districts; their claims were not reviewed for this page and none is described here.

Can I get a refund from Hims & Hers?

The refund article says "we can't guarantee a refund once the pharmacy has processed your order", and the Terms say there are no refunds for partially used subscription periods but that the company may refund "on a case-by-case basis in our sole and absolute discretion". They asked for a written response within 15 working days.
