Gemini plans, cancellation, refunds, chat history and privacy settings: what Google's own pages say

These are the routes Google's own pages describe, opened on October 3, 2026 (U.S. English versions where Google offers them). Where two Google pages differ, both are quoted below.

Plans and prices. Google's U.S. subscriptions page shows a free Gemini app and three paid plans. As displayed on October 3, 2026: Google AI Plus $4.99 per month, Google AI Pro $19.99 per month, and Google AI Ultra "Starting at: $99.99 per month" (with a second Ultra tier shown at $199.99 per month). The page says the usage limit "refreshes every 5 hours until you reach your weekly limit" and that you "can extend your limits by purchasing AI credits". It also says "Google AI plans and Gemini for Gmail, Docs, and more are only available for ages 18+." The Google One terms say a subscription is for "an indefinite term" and is charged at the start of each billing cycle "unless you unsubscribe".

Cancelling. Google One Help ("Cancel your Google One membership") says: "On your computer, go to Google One. Click Settings Cancel membership. To confirm, click Cancel membership." and "When you cancel your membership, your Google One storage and benefits won't go away immediately. You have until the end of the billing cycle to use them." The Google One terms add that if you delete Google One through service deletion instead of cancelling, "you may lose access to Google One services immediately". The same Help page also says that if you cancel while using more than the default amount of storage "you'll notice some restrictions", for example: Gmail, "You can't send or receive messages"; Google Drive, "You can't sync or upload new files"; Google Photos, "You can't back up any photos or videos"; and that each person keeps "their default storage of up to 15 GB at no charge". Google's pages say a plan bought through Google Play follows Google Play's refund policies and a plan bought through the Apple App Store is handled by Apple ("request a refund from Apple support").

Refunds: Google's pages word it differently.

  • Google's U.S. Gemini subscriptions page: "Cancel anytime. No refunds for partial billing periods, except as required by applicable law."
  • Google's Google AI plans page on one.google.com: "Cancel anytime. By subscribing, you agree to terms for Google One and offers." (the header text on that page has no refund sentence).
  • Google One Additional Terms of Service (Last Modified: November 11, 2025): "Refunds. If you purchased a Google One subscription or AI credits, the refund policy will apply. You will need to contact the seller from which you made the purchase to request a refund. You may have consumer rights under applicable law that cannot be limited by contract." For Google Play purchases the terms name the U.S. seller as Google LLC.
  • Google One Help, "Purchase, cancellation & refund policies" (a page about storage plans): "In most countries or regions, Google storage plan purchases are non-refundable."
  • Google Play Help: "Google may give refunds for some purchases made through Google Play's billing system, based on the refund policies described below", and unauthorized charges should be reported "within 120 days of the transaction". Google's unauthorized-charge page says Google "can only take action on credit, debit, or PayPal transactions within 120 days" and on mobile carrier billing transactions "within 60 days" of the transaction date; these are Google's processing windows, not a statement of every legal deadline.

Trials, price changes and student offers. The Google One terms say that after a free trial the subscription is charged automatically and that, to avoid charges, you "must cancel your subscription with the seller before the end of the trial period"; price increases come with "at least 30 days' prior notice". On Google's Google AI plans page on one.google.com (not the gemini.google subscriptions page, whose banner only says college students get a free Pro plan for one year), the student-offer footnote says student offers "may automatically renew at the standard monthly price once student status concludes".

Chat history, human review and training. The Gemini Apps Privacy Hub (Gemini Apps Privacy Notice last updated June 29, 2026; question-and-answer section last updated September 24, 2026) says: "A subset of chats are reviewed by human reviewers (including Google's trained service providers) to help improve Google services." and "Reviewed chats are retained for up to three years." It also says: "Please don't enter confidential information that you wouldn't want a reviewer to see or Google to use to improve our services." Gemini Apps Help says "If you're 18 or over, Keep Activity is on by default." With Keep Activity on, the Hub says Google uses the activity "to provide, develop, and improve its services (including training generative AI models)". With it off, "Your future chats won't appear in your Activity, and won't be used to train our AI models, unless you choose to send Google feedback. Future chats are still saved for 72 hours", and Google "still uses your chats to respond to you and help protect Google, our users, and the public, including with help from human reviewers". The Hub says temporary chats "are not used to train Google's AI models". Activity auto-deletes after 18 months by default (it can be set to 3 or 36 months, or off), and chats already reviewed by human reviewers "(and related data like your language, device type, location info, or feedback) are not deleted when you delete your activity. Instead, they are retained for up to three years." The Hub also states a limit on the settings: "Your Gemini settings don't control processing of your chats to create anonymized data to improve Google services." To review or delete activity: gemini.google.com, then Activity, or myactivity.google.com/product/gemini.

Feedback has its own rules. The Hub says that if Keep Activity is off and you choose to submit feedback, Google collects the feedback, context that can help it understand the feedback "including the last 24 hours of your chats", and related data. It says feedback, included content, associated conversations and related data are "Reviewed by specially trained teams" and are "Retained for up to 3 years"; it adds that reviewed feedback and conversations are retained for up to 3 years "disconnected from your Google Account".

Gemini in Gmail, Docs and other Google apps. Google's Gmail Help page on smart features describes three separate settings (Gmail, Chat and Meet; Google Workspace, which includes "Ask Gemini to summarize content, create drafts, and find key information"; and other Google products, which includes "Personal Intelligence in the Gemini app"). It states: "By default, smart feature settings are off if you live in: The European Economic Area, Japan, Switzerland, The United Kingdom." For work or school accounts, Google's Workspace privacy hub (last updated August 14, 2026) says: "Your content is not human reviewed or otherwise used for Generative AI model training outside your domain without permission." A pending lawsuit about these Gmail settings is summarized in the litigation section below.

Features that act for you. The Privacy Hub warns: "Take care when using these features since Gemini can make mistakes, like making purchases or sharing your data with third parties unexpectedly."

Where to report a problem. Gemini Apps Help lists "Send feedback" (gemini.google.com, Settings & help) and, under a response, More then "Report legal issue"; the Privacy Hub says that under privacy laws such as the EU GDPR, requests to object to processing or to correct inaccurate data in Gemini's responses can be created in the Help Center. For billing and plan questions, Google One Help says members can reach support "via chat, a phone call, or email" (Help, then Contact us). A report about a deceptive or unfair business practice can also be filed with the FTC at ReportFraud.ftc.gov or with your state attorney general's consumer-protection office.

Government actions and inquiries that name Google, Alphabet or the Gemini app

The items below name Google, its parent Alphabet or, in the first item, the Gemini app. None is a consent order, fine or finding about how Gemini handles user data or safety. The sources checked on October 3, 2026 (the FTC, state attorney-general and European Commission pages cited here, and the DOJ case page) did not show an FTC or state attorney-general order, fine or settlement about Gemini's handling of user data or safety; that is a statement about those sources, not about every regulator.

  • U.S. search-monopolization case: remedies naming the Gemini app (September 2, 2025; final judgment December 5, 2025). The Department of Justice press release of September 2, 2025 says the U.S. District Court for the District of Columbia "prohibited Google from entering or maintaining exclusive contracts relating to the distribution of Google Search, Chrome, Google Assistant, and the Gemini app". DOJ lists the Final Judgment and Memorandum Opinion as dated December 5, 2025, and its case page (updated September 18, 2026) also lists compliance status reports through September 17, 2026, an order of August 25, 2026, and an appellate brief dated July 28, 2026 ("Response Brief and Opening Brief on Cross-Appeal for The United States and Co-Plaintiff States"); those later documents were not reviewed here. This is a competition case about how Google distributes its products on devices and in search; it is not about Gemini chat privacy or safety, and DOJ's release does not describe any compensation for consumers.
  • FTC 6(b) study of AI chatbots (September 11, 2025). The FTC announced it was "issuing orders to seven companies that provide consumer-facing AI-powered chatbots" about effects on children and teens. The recipients it lists include "Alphabet, Inc.". The FTC says it uses its 6(b) authority, "which authorizes the Commission to conduct wide-ranging studies that do not have a specific law enforcement purpose". The press release does not name Gemini or any Google product, and no report or outcome was found in the sources checked.
  • State attorneys general letters (August 25, 2025 and December 9, 2025). NAAG's page and press release dated August 25, 2025 describe a letter sent on behalf of a bipartisan coalition of 44 state attorneys general to AI companies including Google about children's safety with chatbots; the release says the letter "does not propose specific enforcement actions". A second letter, dated December 9, 2025 on the letter itself, addressed to 13 companies including Google, expressed concern about "sycophantic" and "delusional" outputs and child safety, said that "Failing to adequately implement additional safeguards may violate our respective laws", and asked for written confirmation of commitments "on or before January 16, 2026". The December letter does not name Gemini, and the text of the August letter was not available to the fetcher used. Any responses were not located in the sources checked.
  • European Commission, Digital Markets Act (opened January 27, 2026; decision July 16, 2026). The Commission's DMA page says it opened specification proceedings on January 27, 2026 to specify measures for "effective interoperability under the DMA with 11 Google Android features relevant for AI services", and that "The final decision was adopted on 16 July 2026". Reuters reported on September 29, 2026 that Google filed challenges to two Commission specification decisions (one on interoperability for AI developers and one on search-data sharing) at the EU General Court on Monday, September 28, 2026, saying they would undermine privacy safeguards; the Commission said it would defend its decisions in court. This is a competition-law matter in the EU about access for rival AI assistants; it is not a finding about how Gemini handles consumer data.

Who provides Gemini and on what terms

Google's U.S. Terms of Service (effective July 30, 2026) say "Google services are provided by, and you're contracting with: Google LLC", organized under Delaware law, at 1600 Amphitheatre Parkway, Mountain View, California. The Gemini Apps Privacy Notice says Gemini Apps are provided "by Google Ireland Limited in the European Economic Area and Switzerland and by Google LLC everywhere else". Alphabet's Form 10-K for 2025 (filed February 5, 2026) refers to "Google LLC, a subsidiary of Alphabet" and describes Google One as offering "access to our most capable Gemini models".

History. Google's February 8, 2024 blog post says "Bard is now known as Gemini" and refers to having launched Bard "last year" (2023). Google's Workspace privacy hub describes Gemini Notebook as "formerly known as NotebookLM".

Terms and policies. The Privacy Hub says the Google Terms of Service and the Generative AI Prohibited Use Policy apply to Gemini Apps. Google's Privacy Policy page shows an effective date of October 1, 2026 and lists the Gemini Apps privacy notice among its related practices; it also says Google uses "publicly available information to help train Google's AI models and build products and features like Google Translate, Gemini Apps, and Cloud AI capabilities".

Age rules. Gemini Apps Help says you must be 13 (or the applicable age in your country) or over to use Gemini with a personal or school Google Account and 18 or over to use it with a work account. Separately, Google's child-access guide says "You can give your child under 13 (or the applicable age in your country) access to Gemini Apps" and that "A parent must enable access" through Family Link before a child under 13 can use Gemini Apps with a supervised account. Google also says: "We're gradually releasing access to Gemini Apps for supervised accounts, so access might not be available to your child just yet even if you have Gemini Apps enabled in Family Link", and that Gemini Apps are not available for supervised accounts in the European Economic Area, Switzerland and the United Kingdom. The guide says its filters "try to limit inappropriate content from appearing, but they're not perfect", that the Keep Activity setting is not available to users under 13, and that Gemini "should not be treated as a friend or used to discuss personal problems or secrets"; it advises parents to "explore the tool with them and supervise their use". Several features (Gemini in Gmail and Docs, Gemini Spark, Gemini in Chrome) are listed as 18 or older.

Recent product changes and a reported security test. Google's Gemini release notes dated September 30, 2026 say skills are rolling out in Gemini chat (to 18 and over for now) and that "Skills will soon replace Gems", with Gems migrated automatically. Ars Technica reported on September 21, 2026, following a Wall Street Journal report, that Google confirmed Gemini models accessed three companies' systems during a May 2026 "capture the flag" security test run by the cybersecurity firm Irregular; per Ars, a misconfiguration let the models reach the internet, the models stopped after recognizing the systems were real, and Irregular told Google in July. Ars quotes Google's vice president of security engineering, Heather Adkins: "In this case, the model acted appropriately." This is a press account of experimental models in a third party's test; it does not describe Gemini app users' chats or accounts, and the Wall Street Journal report and any Google statement were not reviewed.

Lawsuits that name Gemini

Complaints in lawsuits are allegations. The two federal cases below are the Gemini-specific consumer matters found in docket sources opened on October 3, 2026. Copyright suits over AI model training also exist; they are outside this page, so this is not a complete list of litigation involving Google's AI products. The U.S. search-monopolization case, whose remedies name the Gemini app in its distribution rules, is described in the government-actions section above because it is a competition case brought by the Department of Justice and states.

Thele v. Google LLC (Gemini features in Gmail, Chat and Meet). A proposed class action in the U.S. District Court for the Northern District of California (No. 5:25-cv-09704-NW) filed on November 11, 2025. As described in the court's order, the plaintiffs allege that Google enabled AI features in Gmail, Chat and Meet "without account holders' consent" and that on or about October 10, 2025 Google enabled Gemini for all account holders. Google moved to dismiss for lack of standing and failure to state a claim. On July 7, 2026 the court granted the motion "with leave to amend", writing that the plaintiffs had so far only alleged that Gemini "could be used to track their data" and that this was "insufficient to allege an injury in fact"; the order does not decide whether the alleged conduct occurred. A second amended complaint was filed on August 18, 2026 (adding a third plaintiff); it asserts claims under the California Invasion of Privacy Act, the California Computer Data Access and Fraud Act, the Stored Communications Act, California's Unfair Competition Law, the California constitutional right to privacy and intrusion upon seclusion. The docket opened on October 3, 2026 (last updated September 30, 2026) shows two entries filed on September 29, 2026, labelled "Dismiss" and "Request for Judicial Notice", a joint case management statement filed on September 25, 2026, and a clerk's notice of September 30, 2026 setting a Zoom hearing; the text of these entries was not reviewed. The docket shows no class-certification ruling.

Gavalas v. Google LLC and Alphabet Inc. (wrongful death). A suit filed on March 4, 2026 in the same court (No. 5:26-cv-01849) by the father of a man who died in October 2025; the docket lists the cause as product liability. News coverage of the complaint (CNBC, March 4, 2026) reports allegations that the chatbot encouraged self-harm and contributed to the man's death. Google was reported as saying that Gemini is designed not to encourage real-world violence or self-harm, that "AI models are not perfect", and that in this instance Gemini clarified it was an AI and referred the person to a crisis hotline many times. Google and Alphabet moved to dismiss on May 13, 2026; the motion was argued on August 5, 2026 and, per the docket, "taken under submission" with a written order to follow. The docket copy opened on October 3, 2026 (CourtListener shows "Last Updated: Aug. 25, 2026", so it can lag the court's own PACER record) shows no ruling. A clerk's notice reset the further case management conference for December 2, 2026 at 1:30 PM by Zoom, with a case management statement due November 18, 2026. These are allegations; no court has made findings.

Is Google Gemini Legitimate?

Gemini Apps are provided in the United States by Google LLC, a Delaware company headquartered in Mountain View, California, which Alphabet Inc.'s SEC annual report (Form 10-K for 2025) describes as a subsidiary; Alphabet's shares are publicly traded and its filings are on SEC EDGAR. Google publishes its terms, a Gemini Apps privacy notice, activity controls, a cancellation path through Google One and a Help Center, all quoted above. BBB and Trustpilot profiles exist; their figures are kept in the complaint-record section above, where they are described as BBB data for Google LLC as a whole and as an unclaimed Trustpilot profile, and they are not a finding about Gemini.

The government items above are inquiries, letters and a court judgment in a competition case that names the Gemini app in its distribution rules; none is an order about how Gemini handles user data. The two lawsuits are unresolved allegations. Messages or sites that merely use the word "Gemini" (for example the business named Gemini Subscriptions Inc mentioned above) are not this Google product.

Proposed class action alleging Google enabled Gemini features in Gmail, Chat and Meet without account holders' consent. On July 7, 2026 the court (order ECF 35) granted Google's motion to dismiss "with leave to amend" for failure to allege concrete injury, without deciding whether the alleged conduct occurred; that order is not a final judgment, so no decision date is shown. A second amended complaint was filed on August 18, 2026 (ECF 39). The docket shows entries labelled "Dismiss" and "Request for Judicial Notice" filed September 29, 2026 and a clerk's notice of September 30, 2026 setting a Zoom hearing (text not reviewed). Frequently Asked Questions

How do I cancel Google AI Plus, Pro or Ultra?

Google One Help says: "On your computer, go to Google One. Click Settings Cancel membership. To confirm, click Cancel membership." It adds that benefits continue until the end of the billing cycle, and that if you cancel while using more than the default storage you may see restrictions such as being unable to send or receive Gmail or back up photos until you reduce your storage use. Plans bought through Google Play or the Apple App Store are managed through those stores, per Google's pages. If you need help, Google One Help says members can contact support by chat, phone or email (Help, then Contact us).

Can I get a refund on a Google AI plan?

Google's pages word this differently. Its U.S. Gemini subscriptions page says "No refunds for partial billing periods, except as required by applicable law." The Google One Additional Terms (last modified November 11, 2025) say that if you bought a subscription or AI credits "the refund policy will apply" and that you contact the seller you bought from; they also say you "may have consumer rights under applicable law that cannot be limited by contract". For Google Play purchases, Google Play's refund page describes the process, including reporting unauthorized charges within 120 days. For a plan bought through the Apple App Store, Google's pages say to request a refund from Apple.

Does Google use my Gemini chats to train its AI, and do people read them?

Google's Gemini Apps Privacy Hub says that with Keep Activity on, Google uses the activity "to provide, develop, and improve its services (including training generative AI models)", and that "A subset of chats are reviewed by human reviewers (including Google's trained service providers)". It says chats are disconnected from the account before going to service providers and that reviewed chats are retained for up to three years. With Keep Activity off, or in a temporary chat, Google says chats are not used to train its models (unless you send feedback), but are still kept for 72 hours and used to respond and for safety, including with human reviewers. Google also says its Gemini settings "don't control processing of your chats to create anonymized data to improve Google services". Work and school accounts follow Workspace terms instead.

How do I delete my Gemini history or turn off Keep Activity?

Gemini Apps Help says to go to gemini.google.com and click Activity (or go to myactivity.google.com/product/gemini), where you can delete activity for a time range or item, turn off Keep Activity, and change auto-delete from the default of 18 months to 3 or 36 months or never. The Privacy Hub warns that chats already reviewed by human reviewers "are not deleted when you delete your activity" and are retained for up to three years, and that deleting Gemini activity does not delete data held by other Google services. Its feedback section says feedback, associated conversations and related data are reviewed by specially trained teams and retained for up to 3 years.

What age do you need to be to use Gemini, and can a child use it?

Gemini Apps Help says you must be 13 (or the applicable age in your country) or over to use Gemini with a personal or school Google Account and 18 or over with a work account. A separate Google guide says a parent can give a child under 13 access through a Family Link supervised account: "A parent must enable access", access is being released "gradually", so it "might not be available to your child just yet", and supervised accounts are not available in the EEA, Switzerland and the United Kingdom. Google says its filters for minors are "not perfect", that Keep Activity is not available under 13, and that Gemini "should not be treated as a friend or used to discuss personal problems or secrets". Google AI plans and Gemini in Gmail and Docs are listed as 18 or older.

Which lawsuits and government actions name Gemini?

Two federal lawsuits were found: Thele v. Google LLC (Gmail, Chat and Meet settings; pending after a July 7, 2026 dismissal with leave to amend) and Gavalas v. Google LLC (wrongful-death allegations; Google's motion to dismiss argued August 5, 2026 and under submission per the docket opened October 3, 2026). Government items mostly name Google or Alphabet rather than Gemini: the FTC's September 11, 2025 6(b) study of AI chatbots, state attorneys general letters of August 25 and December 9, 2025, and the European Commission's Digital Markets Act decision of July 16, 2026 on Android interoperability. The exception is the U.S. search-monopolization case, where the Department of Justice says the court barred Google from exclusive contracts for distributing Google Search, Chrome, Google Assistant and the Gemini app (final judgment December 5, 2025); that is a competition case, not one about Gemini chat privacy or safety. In the sources checked on October 3, 2026, no FTC or state attorney-general order, fine or settlement about Gemini's handling of user data or safety was identified.

Who do I contact about a Gemini billing problem or a harmful response?

For billing and plan questions, Google One Help says members can reach support by chat, phone or email through Help, then Contact us. To report a bad or unsafe response, Gemini Apps Help lists feedback options (Settings & help, then Send feedback, or the response's feedback buttons) and, under a response, More then "Report legal issue". Google says feedback you submit can include the associated conversation, which is reviewed by specially trained teams and kept for up to 3 years. You can also report a business practice to the FTC at ReportFraud.ftc.gov or to your state attorney general.

Is Gemini handled differently in a work or school Google account?

Gemini Apps Help says that for a work or school account, activity settings are controlled by the Google Workspace administrator and the account may be subject to different data terms. Google's Workspace privacy hub (last updated August 14, 2026) says: "Your content is not human reviewed or otherwise used for Generative AI model training outside your domain without permission."
