Bubak v. GOLO, LLC. A putative class action filed in the Eastern District of California on March 24, 2021. On August 29, 2022 the district court granted in part and denied in part GOLO's motion to dismiss. After GOLO moved for reconsideration, an order signed January 5, 2024 granted reconsideration and granted the motion to dismiss because the remaining claims were preempted, and judgment was entered on January 8, 2024. The plaintiff appealed (Ninth Circuit No. 24-492). In a non-precedential memorandum filed October 9, 2025 the Ninth Circuit affirmed, describing the claim as a California Unfair Competition Law claim premised on an alleged violation of the federal Food, Drug, and Cosmetic Act, which it held to be preempted. The memorandum says further analysis would be needed to decide whether GOLO's marketing actually violated the FDCA, so it does not decide that question. A concurring judge wrote separately on a different Ninth Circuit precedent.
Fischler v. Golo LLC. A civil rights action filed in the Eastern District of New York on March 2, 2022; the docket shows a notice of voluntary dismissal on July 21, 2022 and the case closed. The docket text read does not describe the claims further.
No FTC, FDA or state attorney general action against GOLO, LLC was identified in the web searches run on October 22, 2026; those searches were not a search of each agency's own enforcement database.
