DraftKings complaints: where to take a problem and what we could and could not read

This page was checked on 2026-10-20. Use the Help or Support section of the DraftKings app or website for those steps, and keep screenshots of the bet slip, promotion terms and any messages before you write in.

The only regulator route this page can source: DraftKings' 10-K says it holds surety bonds "for certain regulators' use and benefit in order for the Company to satisfy state license requirements", which means state gaming licences exist in the states where it operates.

More detailShow less

The agency that licenses DraftKings in your state is the place to ask about a regulated-product dispute; for Massachusetts, the Massachusetts Gaming Commission (101 Federal St., 12th Floor, Boston; tel. 617-979-8400, as printed on its site) names Crown MA Gaming, LLC d/b/a DraftKings as the licensee on its licensee page.

If you are a member of a class in a pending case listed on this page, such as a case listed on this page, read the notice you received and do not rely on this page for deadlines; for example, the McAfee class case in Indiana ended in a summary judgment for DraftKings on 2026-09-22 according to the court docket.

Lawsuits against DraftKings, from its SEC filings

All entries on this page come from the legal-proceedings notes in DraftKings' Form 10-K filed 2026-02-13 and Form 10-Q filed 2026-08-07, in which the company says it is involved in many legal proceedings and "intends to vigorously defend" the cases listed. They are allegations and procedural events, not findings of wrongdoing. Statuses are those reported in the 10-Q unless a CourtListener docket is cited.

Consumer promotion and advertising class actions: Scanlon (Massachusetts), Youngs (New Jersey), Beyer (Illinois), De Leon (New York, dismissed) and Macek II (Pennsylvania) challenge the new-customer $1,000 site-credit, "risk-free" and "no sweat" promotions. Courts have reached different results: some claims were allowed to proceed (Youngs, Beyer, Macek II, Scanlon's Chapter 93A claim), while De Leon was dismissed and Macek I was dismissed with prejudice and is on appeal.

Alleged problem-gambling and design claims: the 10-Q reports that beginning March 24, 2026, fourteen individual product-liability lawsuits were filed in Massachusetts, Illinois, New Jersey and Pennsylvania state courts alleging the platforms are defectively designed to encourage compulsive betting; DraftKings filed preliminary objections in four Pennsylvania cases. A purported class action, Farley (S.D.N.Y.), makes related allegations, and Baltimore's suit is described in the case list.

Prediction markets: three suits filed July 28 to August 3, 2026 (Chan, Hughes, Gordon) target DraftKings Predictions; DraftKings had not yet responded when the 10-Q was filed. Hughes is now on the federal docket of the District of South Carolina.

More on the lawsuitsShow less

Company-favorable and non-consumer matters: the Steiner Florida case was dismissed with prejudice and the Zhen court dismissed the money claims on July 29, 2026. DraftKings also reports patent suits brought against it (Winview, Micro-Gaming, Interactive Games and others), a trademark suit by the NCAA filed March 20, 2026 (a temporary restraining order was denied on March 26, 2026), a shareholder derivative suit over its NFT business that the court dismissed with prejudice in a March 3, 2026 written order, and an ongoing IRS audit about the excise taxation of fantasy sports contests. On July 30, 2026 DraftKings and FanDuel filed notices of nonsuit without prejudice in DraftKings' own 2016 suit against the Texas Attorney General over daily fantasy sports.

AI-targeting allegations (September to October 2026): a proposed class action filed in U.S. District Court in Boston on September 30, 2026 alleges DraftKings used an AI model to flag customers as responsive to incentives to keep gambling; WBUR reported DraftKings denies the allegations and quoted its spokesperson: "DraftKings does not use AI to target customers based on losses". These are allegations only. Separately, the Massachusetts Gaming Commission's executive director sent a letter on October 14, 2026 to the state's licensed sports wagering operators asking them to detail their use of artificial intelligence and machine learning in a written response by November 3, 2026, and the Louisiana Gaming Control Board on October 15, 2026 voted to conditionally extend DraftKings' licence through February 19, 2027 with a renewal hearing set for February 18, citing open questions about shareholder suitability filings and the AI allegations; its chairman recognized that news reports are not findings of regulatory violations (CDC Gaming report). These are reviews, not findings.

Other filings: the legal notes in the 10-K and 10-Q do not list a state or federal regulator enforcement action against DraftKings. Federal dockets on CourtListener as of 2026-10-20 also list additional individual cases against DraftKings Inc. (for example D. Colo. 1:26-cv-01692 and E.D. Pa. 2:26-cv-07168); their claims were not reviewed.
