Dave problems: where to go, what to send and how to escalate (checked October 9, 2026)
Dave Inc. runs the Dave app. On dave.com it says "Dave is not a bank" and that banking services are provided by Coastal Community Bank, Member FDIC, or another partner bank. dave.com lists 844-857-3283, in-app chat and a "Send a message" form as contact routes; its Help Center explains that chat is reached in the app under Settings, then scroll down to "Chat with us". The BBB profile lists a different number, (844) 358-3283; that number is shown only as BBB-listed.
Cancel the paid membership. The Dave Help Center article on membership says to go to Settings, scroll down, tap Membership; it adds that your bank accounts can stay open and that "deleting the app will not end your membership or the subscription fee". Two Dave pages word the deadline differently: the article "Canceling your Dave Membership and closing your bank accounts" and Terms of Use section 7.2 say you "must cancel a minimum of 3 business days before your next subscription fee is charged" to avoid the next month's charge, while the "Dave Membership" article says cancelling stops the fee "at the end of your current membership cycle". Terms section 7.2 also allows cancellation by emailing [email protected]. dave.com says the membership costs "up to $5 per month".
Close the bank accounts. Dave's help article says to settle any unsettled balance first, move remaining money out, then use Settings, Edit profile, "Close my Dave Account"; closing accounts is a separate step from cancelling the membership.
ExtraCash fees as Dave states them today. dave.com says ExtraCash amounts range from $25 to $500, are "typically authorized within 5 minutes", carry an overdraft fee "equal to the greater of $5 or 5%", and that "Not all members qualify for ExtraCash and few qualify for $500". Its Help Center article "What are ExtraCash Fees?" says the overdraft service fee is 5 percent of the transfer (minimum $5), added to the settlement total; sending to Dave Checking has no express fee, sending to an external debit card within one hour costs 1.5 percent, and an ACH transfer to an external bank (2 to 3 business days) has no fee. Dave says there is no interest, credit check or late fee.
Card transactions you do not recognise. Dave's article "Filing a dispute" says to freeze or replace the Dave Debit Mastercard, that "pending transactions cannot be disputed" until they post (up to 3 business days), and that disputes are filed by calling the number on the back of the card or writing to the address on the bank statement. The article lists what to have ready: the full account or debit card number, the merchant name, amount and date, the reason, and supporting documents such as receipts; give the full account or card number only to Dave through the phone or mail route on the card or statement, not in a public complaint or review.
If an ExtraCash settlement is not paid in full. Dave's article on payment authorization says each ExtraCash settlement is authorized as a "one-time payment" that is not eligible for revocation or cancellation, and that if there are not enough funds on the settlement date it will "attempt additional partial transfers to settle over time", with no late fees or penalties. If a transfer is a concern, contact Dave's Member Success team through in-app chat and keep the date and amount of each debit.
Account migration. Dave's Help Center says it is moving banking services from Evolve Bank & Trust to Coastal Community Bank, with new account and routing numbers and a new debit card, and asks members to update automatic bill payments. Dave's Form 10-Q for the quarter ended June 30, 2026 states that "all new Members are being onboarded to Coastal" and that it expects the transition of existing members to be "substantially finalized by the end of 2026"; those are the company's statements and expectations. Some older Dave help pages still name Evolve, so check the bank named in your own account agreement.
Terms before a lawsuit. Dave's Terms of Use contain an arbitration agreement with a 60-day opt-out by written notice to [email protected]; the Coastal ExtraCash agreement says claims not arbitrated go to a court in Snohomish County, Washington. The Terms (section 19) also say the Informal Dispute Resolution process "lasts forty-five (45) days and is a mandatory precondition to commencing arbitration". Read both documents for your own account.
Outside complaint routes. The CFPB accepts complaints about financial products at consumerfinance.gov/complaint and says "Most companies respond within 15 days"; the FTC takes reports of bad business practices at reportfraud.ftc.gov; your state attorney general and state financial regulator are also options.
Government actions: the FTC/DOJ lawsuit (filed 2024) and the City of Baltimore suit (2025-2026)
FTC / Department of Justice (federal court, Los Angeles). The 10-K for 2024 says the FTC sent Dave a Civil Investigative Demand in January 2023, sent a proposed consent order and draft complaint on August 21, 2024, filed a complaint on November 5, 2024, and then referred the case to the Department of Justice, which filed an amended civil complaint on December 30, 2024 naming Dave and its chief executive, Jason Wilk. The amended complaint (Document 44) states five counts: misrepresentations about cash advances and about "tipping" charges under Section 5(a) of the FTC Act, and, under the Restore Online Shoppers' Confidence Act, failure to provide clear and conspicuous disclosures, failure to obtain express informed consent, and failure to provide simple mechanisms to stop repeating charges. Among its allegations: that during the first 14 months after Dave began advertising advances of up to $500 it offered a $500 advance "only 0.002% of the time", that the most common offer was $25, that more than three-quarters of the time a new user was offered no advance, that an "Express Fee" of $3 to $25 applied to avoid a delay, that a default 15 percent "tip" was taken on many advances, and that a $1 monthly membership was charged "frequently without their knowledge or consent". It asks for a permanent injunction, monetary relief and civil penalties. These are allegations, not findings.
Dave's position. The 10-K says Dave "believes that its practices have at all times been in compliance with applicable law", that it recorded a $7 million litigation and settlement accrual for the matter in 2024, and that it cannot reasonably predict the outcome. Separately, Dave's Form 10-Q for the quarter ended June 30, 2026 reports an aggregate accrual for legal contingencies of $9.7 million as of that date; it covers all matters Dave describes there and is not a figure for the FTC/DOJ case alone. Dave's August 2026 earnings release describes "litigation expenses related to the FTC/DOJ matter" as an item excluded from its adjusted measures.
Docket status. The CourtListener docket for case 2:24-cv-09566 shows an order on September 12, 2025 denying defendants' "Motion to Dismiss for improper substitution", an answer with jury demand filed October 10, 2025, a civil trial order of November 14, 2025 setting a final pretrial conference for November 9, 2026, discovery disputes in 2026, and a stipulation (October 5, 2026) and an order (October 6, 2026) about deadlines and hearings whose text is not available on CourtListener. No judgment, settlement or consent order appears on the docket; the newest entry listed on CourtListener when opened on October 9, 2026 was the order of October 6, 2026.
City of Baltimore. The Mayor and City Council of Baltimore sued Dave in the Circuit Court for Baltimore City on December 30, 2025 under the city's consumer protection ordinance, seeking an injunction and civil penalties for alleged deceptive and unfair trade practices tied to ExtraCash, including the allegation that it has "every fundamental feature of a loan" and was provided without a Maryland license. Dave removed the case to the U.S. District Court for the District of Maryland on January 29, 2026 (1:26-cv-00369), and on August 18, 2026 the court denied the city's motion to remand. The city's claims are allegations; no merits ruling appears on the docket, whose newest entry on October 9, 2026 was the August 18 opinion.
CFPB enforcement. A search of the CFPB's Enforcement Actions page with the title filter "dave" returned "Sorry, there were no results" on October 7, 2026; that scoped check does not cover other agencies or state regulators.
Dave Inc.: who operates Dave and how it works
Dave Inc. is a Delaware corporation listed on Nasdaq under the symbol DAVE, with principal offices at 1265 South Cochran Ave, Los Angeles, California 90019. Its 10-K says it took the name Dave Inc. after a business combination with VPC Impact Acquisition Holdings III, Inc., and that the surviving operating entity is Dave Operating LLC (the licence holder named on dave.com, NMLS ID 2675197). Jason Wilk is listed as co-founder, president and chief executive. The 10-K says "Legacy Dave was incorporated in October 2015"; BBB's raw data lists a business start in 2017 and incorporation in 2016, so the founding year is left blank here.
The company says it has "14M+" members. The app offers ExtraCash (an overdraft service on an ExtraCash deposit account, up to $500 if eligible), Dave Checking, a Goals account, a paid membership of up to $5 per month, and "Side Hustle" income listings; dave.com says eligibility is decided by its CashAI model using "180+ data points" and no credit check. Dave's Terms of Use define its accounts as including "Dave Flex and DDAs including Dave Rent, Dave Checking Account", the Dave debit Mastercard, the Goals Account and the ExtraCash Account. The Form 10-Q for June 30, 2026 says that in April 2026 Dave "began a limited test of Dave Flex", a Mastercard-branded credit card with a pay-in-four installment feature issued through Coastal Community Bank, with a small group of existing members; it states that Dave earns an installment fee of 3 percent of the outstanding balance at the end of each two-week purchase period and charges a monthly participation fee to each member with an open Dave Flex account, and that Dave Flex receivables and fee revenue were immaterial for the period.
Bank partners. The Form 10-Q for the quarter ended June 30, 2026 says that all new members are being onboarded to Coastal Community Bank and that Dave expects the transition of existing members to be substantially finalized by the end of 2026; it still refers to Evolve Bank & Trust as its primary bank partner for accounts not yet moved. The 10-K for 2024 had described ExtraCash and Dave Checking accounts as issued by Evolve and said Dave also had a relationship with Coastal. The Terms page lists Coastal and Evolve versions of each account agreement, and dave.com names Coastal Community Bank. A June 9, 2026 press release says Dave began transitioning ExtraCash receivables to a funding arrangement with Coastal effective June 1, 2026; the Q2 2026 release says $93.0 million was outstanding under that structure at June 30, 2026. In 2024 Evolve experienced a cybersecurity incident; Dave's help page and its 10-K say members' names, Social Security numbers, account numbers, dates of birth and contact details were improperly disclosed, and Evolve offered two years of free credit monitoring.
The 10-K also describes two 2020 security incidents at Dave (one involving read access to member profiles, one involving a third-party service provider and encrypted Social Security numbers) and says Dave settled a purported California class action for about $3.1 million and individual claims outside California for about $4.4 million.

- Russell, Preston and Tosches v. Dave Inc. and Evolve Bank & Trust (C.D. Cal. 2:25-cv-04029, removed May 5, 2025 from Los Angeles Superior Court). The amended class complaint, brought by three active-duty U.S. Army service members, alleges that Dave's ExtraCash product violates the Military Lending Act, the Truth in Lending Act and the Georgia Payday Loan Act. On December 12, 2025 the court denied defendants' motion to dismiss class claims and stay individual claims in favor of arbitration; defendants appealed to the Ninth Circuit (No. 26-12), the district case was stayed pending appeal, and the Ninth Circuit noticed oral argument for November 16, 2026. Allegations are not findings.
- Golubiewski and Checchia v. Dave Inc. (M.D. Pa. 3:22-cv-02077). The 10-K describes it as a purported class action under Pennsylvania state and federal law. Terms are not stated on the docket.
The government cases are described under regulator actions above.
Is Dave Legitimate?
Dave Inc. files annual, quarterly and current reports with the SEC (CIK 0001841408, Nasdaq: DAVE), identifies its headquarters as 1265 South Cochran Ave, Los Angeles, and says its accounts are provided by FDIC-member partner banks (Coastal Community Bank, with Evolve Bank & Trust named in older documents). dave.com lists Dave Operating LLC with NMLS ID 2675197.
The public record also contains government and private allegations about how ExtraCash, fees, "tips" and membership charges were advertised and billed: a federal lawsuit by the United States (FTC referral) pending in C.D. Cal., a City of Baltimore consumer-protection suit, a servicemember class action on appeal, and CFPB complaints. Dave disputes the federal allegations and says its practices have complied with law; none of these matters has produced a merits judgment or final order on the dockets checked on October 9, 2026. BBB shows the profile as under review with no rating, and no Trustpilot figures are used because a Dave Inc. profile was not identified. Readers should compare the company's current fee disclosures with their own account agreement before relying on any advertised amount.

Closing bank accounts is a separate step.
What does ExtraCash cost according to Dave?
dave.com says amounts range from $25 to $500 with an overdraft fee equal to the greater of $5 or 5 percent, an optional 1.5 percent fee for external debit card transfers, and a membership of up to $5 a month.
