Incident happen at a kroger store in fishers on 08/22. My new 2013 mazda cx5 got scratched by carts that the employee left while trying to gathering more carts before taking them into the store. The employee saw me put my grocies in my car and then i gave him my cart. I looked thru my back up camera in my car and saw the employee pass by. I assumed that he was going inside. I back up slowly out of my space and i heard some kind of sound. I knew it couldn't be my brand new car so i back up slowly again remind u that nothing was in my view. I then stopped and got out of the car and that is when i saw these carts up against my car. The carts made one big long scratch from the driver door to the back near the gas tank. I was furious then. There was a lady next to me putting her grogeries away and asked if i needed a witness. Of course i said yes. I went inside and ask for the manager and we all went outside to look at my car and to explain what happen. The manager took pictures and took my witness information. I then followed the manager back inside to fill out a claim report regarding the incident. The bad part is the employee that was gathering the carts didnt's even apologize. He was still outside gathering more carts like nothing happen. After a couple of days i contacted this sedgwick ins co and gave them my statement and they told me that they would contact me after getting more information from the store. Guess what - they called and stated that they contacted my witness and also had another witness and after reviewing they came to a conclusion that they are not liable for the damage to my new car. I also asked to see the video and they replied there is no video. I asked then how can you deny my claim when clearly this is a he said she said case now. Also, if you have no video how save is it if something really happen outside your store in the parking lot. I got frustrated after talking to the claim examiner i told her that this wasn't the end and that she would be hearing from my lawyer and my insurance company since i now have to file a claim with them to repair my car. The bad thing about it is that i have to pay for the collision side of my policy deductible which cost $1000 and the remaining will be paid by my insurance company including rental. I see that there are alot of claims out here regarding sedgwick company and it's unreal. I will not give up. Last thing - don't stop at kroger because if anything would really happen to you there is no camera to help you solve the case. Kroger takes no liability for their stores or their customers for that matter. Safety is not a issue with them. You're on your own at a kroger store. Again i will continue to fight. Not giving up and i think no one should that is having issues.
