Bank Refused to Cash Its Own Check for Non-Customers

Bank of America refuses to cash a check. All we wanted was to cash a check drawn at Bank of America and give us a cashiers check.

We walked in and they said that they would not cash check for the amount and they don't cash checks for non Bank of America customers.

This is a violation of the law.
If someone writes a check to someone, it is because they owe the payee money. The money represented by that instrument is the property of the payee. It is not in "escrow"; the property rights to the money represented by that instrument are not dependent upon the banks' willingness to cash the check, and if the bank refuses to cash the check for any reason or no reason at all (other than insufficiency of funds), the bank is engaging in "unlawful detainer" of the property of the payee - this constitutes theft.

I will be looking in suing Bank of America. I hope lots of people will join me.
