Took my money and never provided me with service or product

On December 08 I purchased a pair of eye glasses at Classical Eye because while at that store my own glasses were dropped and broken. I wear glasses 100% of the time I needed glasses right away. At the time of purchase I was not notified that there was a freeze on the model that I ordered.

After 10 business days of not hearing from Classical Eye, manager Carlos Hernandez, I called to get status. At that time he told me that he had ordered the glasses but were not in yet. Two weeks later I called and was then told of a freeze on orders until January 15th. Two weeks after the 15th I had to call again because I had not heard from anyone.

At this point I went to the Classical Eye and was told they were shipped and it should be two days for them to instal the lens. Again I did not hear back from Carlos or any employee from the store. The following week I went back to the store and another employee, Alex, provided no info and unprofessional service. I then left a message for Carlos I did not want to do business with them and wanted my money returned.

Carlos did not want to return my money but he wanted to work something out. I called back and was told he was gone til the 11th of February. He did not leave instructions to any other employee, again nothing resolved. No other manager available either. When I did speak to Carlos and asked him to return my money because I did not want to do business with a company that took a customer's money upfront and no longer cared to provide good service.

I paid $846.00 for this frame. Carlos said he could not make this decision. He said he needed to speak to his manager. At this point Carlos just wanted to give me the glasses but I did not want to do business with them any longer. I emailed the coorporate office at to file a complaint, twice with no response. It is almost four months and I have no glasses, no refund, and no call from this company.

ON the 20th of February I filed a complaint with the BBB and they too were unable to get a response with two attempts. Can someone suggest what steps to take next, small claims court? I don't wish this to happen to anyone so be aware of this complany that scams consumers.
